GENERAL
New requirements on Occasional Survey to All Vessels of Twenty (20) Years Age or More Prior to Calling a Port of the Paris MOU (MMC221, CCS Circ 081)
1 Suspension of occasional survey (including ISM, ISPS audit) on ships of 20 years and above before heading to water areas of member states of Paris MOU.
2 For ships of 20 years and above with multiple retention records in members states of Paris MOU, competent authorities of Panama requires occasional survey. In this case, CCS will act according to CD326 Circular.
3 Ships of 20 years and above are required to receive evaluation on technical state before applying for registration of Panama flag, and in case of ships with high risk of detention, competent authorities of Panama will refuse their registrations.
Exemption, Equivalents, Conditional, Interim and Full-Term certificates(MMC-156)
1. Panama Administration may grant to an individual ship, exemptions from the provisions of a Convention if the ship complies with the conditions established by such convention, for the specific exemption.
2. When an exemption is granted to a ship under and in accordance with the provisions of an International Convention an Exemption Certificate are to be issued in addition to the certificates requested by those Conventions.
3. A request for an Exemption Certificate shall be sent to the Segumar Panama Office by the Ship’s owner/operator, legal representative or this Society.
4. The request must be made for each individual ship separately and must include the following:
1) Copy of the Provisional/Permanent Certificate of Registry (Pantente), (optional)
2) Copy of the relevant full term statutory certificate and its attached forms and/or supplements.
3) Application for exemption Certificate properly filled out.
5. In cases where the Exemption Certificate is requested for the first time, the issuance of the Exemption Certificate is of complete prerogative of the Administration; it means that this Society will not issue an Interim Exemption Certificates without authorization of Segumar Offices.
6. In cases where there is a renewal or the original Full Exemption Certificate previously issued by this Administration is lost or damaged, CCS may issue a Provisional exemption certificate which validity will not exceed five (5) months. During this time frame users must apply for the issuance of the Full Term Exemption Certificate and proceed with the correspondent payment.
7.Considering the entry into force of amendments to MARPOL Convention Annexes I and IV (MEPC.330(76), three certificates will be involved with exemption certificate of unmanned non-self-propelled barges:
IOPP certificate/ IAPP certificate/ ISPP certificate.
8. The Panama Flag Equivalent Certificate shall be applied for by CCS H.Q to the administration, then the administration will issue the Equivalent Certificate.
9. Panama Flag accepts the issue of a conditional certificate in the event that the ship or equipment does not comply with the requirements of the Convention in the seaworthiness condition of the ship prior to rectification, subject to the assessment by the RO authorized by Panama, and the RO shall confirm the cause analysis, corrective action and corrective evidence, etc. and shall report to the administration as required before the expiry of the conditional certificate. In cases where a full-term certificate loses its validity due to overdue annual, periodical, intermediate or outside of the ship’s bottom endorsements, an authorization to issue a Conditional Certificate may be requested to the Administration through Segumar Offices, as a transitional measure until the correspondent revalidation survey is carried out and certificates validity is restored. The conditional certificate is valid for a maximum of 90 days, and the competent authority will not authorize the renewal of the conditional certificate or issue the conditional certificate again, and the renewal period of the full-term certificate shall not exceed 90 days.

Issuance of Conditional Certificate (MMC-156)
1. In cases where the condition of a ship or its equipment does not comply with the requirements of an International Convention, this Administration may authorize CCS to issue a Conditional Certificate, provided that the ship is fit to proceed to sea without harm to the ship, persons on board, or without presenting unreasonable threat of harm to the marine environment, allowing the vessel to proceed to a port where the necessary repairs may be carried out.
2. This Society will ensure that the corrective action will be taken and shall, in due course, notify this Administration. Evidence of the corrective actions taken, may include, but are not limited to: survey reports, re-issued certificate, or a formal notification in written. These survey reports and certificates are to be sent to the Administration by CCS Headquarters. If such corrective action is not taken before the expiration date of the Conditional Certificate, the Certificate shall be withdrawn and the Administration shall be notified immediately.
3. In cases where a certificate loses its validity due to overdue annual or intermediate endorsements an authorization to issue a Conditional Certificate may be requested to the Administration through Segumar Offices, as a transitional measure until the correspondent revalidation surveys are carried out and new certificates is issued.
4. The request for authorization to issue Conditional Certificates shall be sent to the Segumar Offices in cases where considered necessary by the owner, operator or legal representatives or by CCS Headquarter. Under no circumstances the Conditional Certificate shall be issued without the previous authorization of Segumar Offices.
5. The request must be made for each individual ship separately and must include:
a) Reasons to issue a Conditional Certificate
b) Copy of the current statutory certificate, available onboard, relevant to the Conditional Certificate.
6. The validity of a Conditional Certificate must not exceed ninety (90) days. This Administration will not authorize the extension or re-issuance of such Conditional Certificates, and will not authorize extensions of statutory certificates exceeding ninety days. In exceptional circumstances and previous a comprehensive evaluation by Segumar Offices, it might be consider granting longer validity periods of Conditional Certificates, the extension or re-issuance of existing conditional certificates.

Extension of Statutory Certificates (MMC. No.91)
Only the Department of Maritime Safety (SEGUMAR) is authorized to extend or authorize the extension of the validity of statutory certificates.

"To the satisfaction of the Administration" Criteria (MMC192)
The General Directorate of Merchant Marine will apply, in all cases in which the conventions ratified by the Republic of Panama mention the phrase "to the satisfaction of the Administration", the rules or interpretations made by national or international standards, or standards developed by experienced organizations for these cases, such as unified interpretations of the International Association of Classification Societies (IACS).
The General Directorate of Merchant Marine of the Panama Maritime Authority, may establish their own interpretations to provide satisfactory ways of complying with certain provisions of the Conventions; in which case, it is applied exclusively to all ships of the National Merchant Marine.

Measurements to Reduce PSC Detentions and improve the performance on Panamanian Vessels(MMC-380/RESOLUTION No.106-019-DGMM)
In order to reduce the detention of the Panamanian flag and to improve the performance of the Panamanian flag fleet, the Panama Maritime Authority issued MERCHANT MARINE CIRCULAR MMC-380 and RESOLUTION No.106-019-DGMM, which required the authorized RO to take the following measures:
As of 15 April 2023, the Panama Maritime Authority will take the following measures:
Each ship that is at risk of being detained, due to the fact that its history of Port State Control inspections in the last twenty-four (24) months, evidencing a breach on the applicable international regulations, regardless of its year of construction, may undergo an Occasional Survey carried out by the RO that issued the SMC Certificate, if it is required by the General Directorate of Merchant Marine.
Each ship older than ten (10) years of construction and considered with a high -risk factor by the United States Coast Guard (USCG), Paris MOU and the Tokyo MOU, shall be subject to an Occasional Survey, carried out by the RO that issued the SMC Certificate.
The Customer shall arrange for the provisional survey to be completed prior to the ship's arrival at USCG ports, Paris Memorandum Ports, Australian ports and Chinese ports. The Customer is advised to apply at or before the port of departure at the earliest possible time in consideration of the possible correction of defects.
The Panamanian regulatory authorities have issued pre-arrival inspection requirements specifically targeting PSC inspections from Italy, reminding to pay attention to their implementation.

Regulation for the Safety of Vessels under 500GRT(MMC-299)
All cargo vessels of the Republic of Panama under 500 GRT holding an international Registry Certificate.
The Resolution 106-138-DGMM does not apply to:
a) Ships of less than 100 GRT or less than 24 m in length.
b) Non propelled vessels.
c) Pleasure yacht not engaged in trade.
d) Fishing Vessels.
Panama Administration has authorized the Society to issue:
- Cargo Ship Safety Certificate (for cargo ship less than 500 gross tonnage) ;
- Cargo Ship Safety Radiotelephony Certificate (for cargo ship less than 300 gross tonnage) ;
as per requirement of Resolution No. 106-138-DGMM, dated 10 September 2013.
Full-term Certificates might be extended only after previous authorization from this Administration.
Name of the surveyor shall be reflected on the Interim Certificates.

This
Merchant Marine Circular supersedes MMC-47
1.The
following list of documents required to be kept on board Panamanian flag
vessels.

Book, including official logbook, crew logbook, oil record book and emissions. The
Official Logbooks should be retained for a period of at least two years from
the date of closing. In the event of a casualty occurring, it shall be retained
for as long as instructed by the Administration.
2.Consular
Fees
The
Panamanian Consuls will charge fees for some services according to the standard
fees.
3.Legalization:
Some
logbooks and documents need to be legalized by Panamanian Consuls. Consuls may
legalize any document or book and charge for it.
4.Detention
of Vessels:
Only
the Directorate of Consular and Maritime Affairs can request the detention of
Panamanian flag vessel.
5.Safety
Inspections:
Without the express authorization of the
Maritime Safety and Navigation department the annual safety inspection cannot
be performed.

Panama Flag Precheck Process
GENERAL
关于对船龄20年及以上船舶驶往巴黎备忘录成员国水域前的临时检验新的检验要求(MMC221,CCS Circ 081)
1 暂停船龄 20年及以上船舶驶往巴黎备忘录成员国水域前的临时检验(包括ISM,ISPS审核)要求。
2 船龄20年及以上船舶如果在巴黎备忘录出现多次滞留,巴拿马主管机关将要求进行临时检验。此种情况,我社将参照CD326通函执行。
3 船龄 20年及以上船舶申请注册巴拿马旗需要提前进行技术状况评估,如果船舶为高滞留风险船舶,巴拿马主管机关将拒绝其注册。
免除、等效、条件、临时和全期证书的签发 (MMC-156)
1.如果船舶申请的特定免除项目满足公约所规定的免除条件,则巴拿马主管机关可批准此项免除。
2.如果船舶被准予免除国际公约有关条款的要求,则除按公约要求签发有关法定证书外,还应签发相应的免除证书。
3.船舶所有人/经营人、法定代表人或本社应向Segumar Panama Office申请签发免除证书。
4.免除申请应针对每一船舶分开办理,各应报送以下资料:
1)船舶临时/永久注册证书复印件。(非强制)
2)免除证书对应的全期法定证书(含证书附录等)复印件。
3)正确填写完毕的免除证书申请表。
5.免除证书的初次签发,必须由主管机关(Segumar Panama Office)受理且签发。除非经主管机关同意,本社不得签发临时免除证书。
6.如需换新或主管机关签发的免除证书正本遗失或损毁,CCS可签发有效期不超过5个月的临时免除证书。在此期间,船东必须申请签发全期免除证书,并支付相应的费用。7.考虑到MARPOL附则I和附则IV修正案已经生效(MEPC.330(76)),非自航驳免除证书的签发主要涉及以下三个证书:
IOPP证书/IAPP证书/ISPP证书。
8.巴拿马旗等效证书由CCS总部向主管机关申请,由主管机关负责签发并作为相关法定证书的一部分。
9.巴拿马接受在船舶或设备不符合公约要求经其授权RO评估在纠正前船舶适航条件下签发条件证书,RO应确认原因分析、纠正措施及纠正证据等在条件证书到期前按要求报告主管机关封闭。如检验过期导致证书失效,应经主管机关授权签发条件证书作为过渡措施,直至相关定期检验完成后原法定证书
恢复有效。条件证书最长90天有效,主管机关不会授权条件证书展期或再次签发条件证书,全期证书展期不超过90天。
条件证书的签发 (MMC-156)
1. 在船舶或其设备不符合国际公约的要求情况下,主管机关可以授权CCS签发条件证书,在保证船舶适合继续航行且不会损害该船,船上人员,不会呈现破坏海洋环境的威胁情况下允许船舶驶往可以进行必要修理的港口。
2. 本社应确保采取修理和纠正措施,并应及时通报主管机关。所采取的修理和纠正措施的证据,可包括但不限于检验报告、重新签发的证书或正式的书面通告。检验报告和证书由总部报送主管机关。如在条件证书到期前未采取修理和纠正措施,证书应被撤销,并立即通报主管机关。
3. 如证书因年度或中间检验的签署超出窗口期而失效,可通过Segumar Offices向主管机关申请签发条件证书的授权,作为过渡性措施,直至进行相应的检验并签发新证书为止。
4. 如船东、经营人、法定代理人或本社总部认为有必要,应向Segumar Offices提出授权签发条件证书的申请。在没有Segumar Offices事先授权的任何情况下,不得签发条件证书。
5. 每艘申请条件证书的船舶均应报送以下资料:
a)签发条件证书的理由;
b)与拟申请条件证书相对应的、船上现有法定证书的复印件。
6. 条件证书的有效期不得超过90天。主管机关原则上不会批准条件证书的延期或重新签发,也不授权签发有效期超过90天的条件证书。在特殊情况并在综合评估下,Segumar Offices可考虑延长条件证书的有效期,延长或重新签发现有的条件证书。

“主管机关满意”的标准(MMC192)
对于巴拿马接受的国际公约中所有提及"to the satisfaction of the Administration"措词,PMA宣布接受国家制定的规定或解释以及国际标准,或接受有经验的组织制定的标准,如IACS的统一解释等。
对满足公约具体规定的符合方式,PMA还可以作出自己的解释,适用于所有巴国商船。

减少PSC滞留提高巴拿马旗船舶表现的措施((MMC-380/ RESOLUTION No.106-019-DGMM )
巴拿马主管机关为减少巴拿马旗滞留和提高巴拿马旗船队表现,发布了第380号通函, 自2023年4月15日起,巴拿马主管机关将采取如下措施:
要求根据24个月内PSC检查记录有滞留风险的船舶,根据其要求由负责签发SMC证书的RO执行一次临时检验。
对10年船龄以上并被USCG、巴黎备忘录和东京备忘录判定为具有高风险的船舶,应由负责签发SMC证书的RO执行一次临时检验。
客户应安排在船舶抵达USCG港口、巴黎备忘录港口、澳大利亚港口和中国港口之前完成临时检验,考虑到可能发现缺陷的纠正,建议客户在出发港或之前尽早时间申请。
巴拿马主管机关特别针对意大利PSC检查发布了抵港前检查要求,提醒注意落实。

巴拿马明确2025年5月1日起授权CCS依据Resolution No. 106-138-DGMM, dated 10 September 2013签发:
- 《货船安全证书》(Cargo Ship Safety Certificate)-500总吨以下;
- 《货船无线电话证书》(Cargo Ship Safety Radiotelephony Certificate)-300总吨以下。
同时强调临时证书不可展期,全期证书由主管机关签发并经主管机关批准可以展期,验船师名字应写入临时证书中。

1.巴拿马旗船上要求携带如下法定文件:
1. 船旗国文件(具体详见本通函第4节)
2. 法定检验证书
3. 日志,包括航海日志、船员日志、油类记录簿和排放记录簿。日志应至少保留两年,在发生意外事故的情况下,应按照主管机关的指示期限保存。
2.领事费用
巴拿马领事将根据标准收费表收取服务费用。
3.合法化:
部分日志和文件需要由巴拿马领事合法化具有法律效力并收取相应费用后才能使用。
4.扣押船舶:
只有领事和海事部门(Directorate
of Consular and Maritime Affairs )可以要求扣留巴拿马旗的船舶。
5.安全检查:
未经海上安全航行部门(the
Maritime Safety and Navigation Department )明确授权,不得进行船旗国年度安全检查。

巴拿马旗船舶预检查程序(MMN-11/2024,February 2025)
预检查程序适用于:
1. 申请巴拿马旗注册登记;
2. 已注册巴拿马旗国际航行,申请更换船东或租家。
对于已注册巴拿马旗国际航行的船舶,如仅更换船名或运营公司,预检查不是必须的。
预检查申请应在注册前提出,15个自然日内有效。
