1. OBJECTIVES
This Circular aims:
1.1 To provide rules on the construction and certification of vessels using composite materials in order to encourage the development of the boatbuilding industry;
1.2 To strengthen and support the expansion and modernization of the Philippine domestic merchant fleet and its strict adherence to safety standards which will ensure the seaworthiness of all sea-borne structures; and,
1.3 To ensure that all vessels constructed in the Philippines using composite materials are in accordance with the safety and environmental standards imposed by the Administration.
2. COVERAGE
This Circular shall apply to all vessels using composite materials, either imported or locally constructed, or to be constructed.
3. GENERAL PROVISIONS
3.1 A shipbuilding/boatbuilding permit from the Administration shall be required prior to construction, modification or conversion of the vessel.
3.2 The MARINA-Registered Shipbuilder/Boatbuilder shall be responsible for ensuring that the vessel is constructed, modified or converted based on the approved plans, specifications and all applicable standards, rules and regulations.
3.3 All ship plans and specifications for construction, modification or conversion submitted to the Administration shall be duly sealed and signed by a Registered Naval Architect. While electrical plans shall be signed and sealed by a Professional Electrical Engineer as per MC 2015-07.
3.4 The Administration, in performing its oversight and monitoring functions, shall supervise the conduct of survey during the stages of construction, modification or conversion of the vessel by its Local Classification Societies as per MC 165, as amended or Recognized Organizations as per MC 2018-01.
3.5 Vessels with hull constructed with wood and covered/coated with FRP or of similar construction shall not be considered as vessels using composite material.
3.6 Composite materials shall not be allowed to be used for Fuel Tanks.
3.7 Commercial Passenger boats shall be designed either using mono-hull, twin hull form 2 or tri-hull form 2 sufficient enough to withstand adverse weather and sea conditions. The operational limitations of the vessels taking into consideration the area of navigation shall be reflected in the Authority to Operate.
3.8 The strength and construction of hull(whether mono-hull or multi-hull), superstructures, deckhouses, machinery casings, companion ways and any other structure and equipment shall be sufficient enough to withstand adverse weather and sea conditions.
3.9 Certificate of Class shall be submitted to the Administration prior to the issuance of Safety Certificates. The LCS or member of IACS shall identify and reflect in the Certificate of Class the operational limitations of the vessels taking into consideration the area of navigation which will be approved by the Administration.
4. SPECIFIC PROVISIONS
4.1 FOR VESSELS USING COMPOSITE MATERIAL UP TO 24 METERS IN LENGTH
4.1.1 All vessels using composite material up to 24 meters in length covered under this Circular shall submit to the Administration all necessary ship plans and specifications prior to construction, modification or conversion in accordance with the approved classification rule books and applicable national standards of the Administration (such as ISO12215 or its equivalent Philippine National Standards (PNS)).
4.1.2 All vessels using composite material up to 24 meters in length covered under this Circular shall undergo periodic inspection/survey by the Administration during construction, modification or conversion prior to registration and issuance of statutory certificates, if applicable.
4.2 FOR VESSELS USING COMPOSITE MATERIAL OF ABOVE 24 METERS IN LENGTH
4.2.1 All vessels using composite material above 24 meters in length covered under this Circular shall be classed by a Local Classification Society or member of IACS. Plans, drawings and scantling calculations and any revisions relevant to the construction, modification or conversion of the vessel shall be reviewed and approved by LCS or member of IACS prior to submission to the Administration.
4.2.2 The Local Classification Society or member of IACS shall be responsible for ensuring that the vessel is constructed, modified or converted and properly maintained in accordance with the approved classification rule books by the Administration and applicable national standards of the Administration.
4.2.3 The Local Classification Society or member of IACS surveyor shall perform surveys during the construction and assembly of the hull, machinery and equipment.
5. DOCUMENTARY REQUIREMENTS
5.1 The following requirements shall be submitted to the Administration for the issuance of Shipbuilding/Boatbuilding Permit prior construction, modification or conversion:

6. SAFETY RESPONSIBILITIES
6.1 The ship owner shall be responsible for maintaining and operating their ships in accordance with the applicable national standards, rules and regulations of the Administration.
6.2 The shipbuilder/boatbuilder shall be responsible for constructing, modifying or converting the ship in accordance with the approved plans and specifications by the Administration or its LCSs or Member of IACS.
6.3 The Local Classification Societies/Member of IACS shall be responsible for reviewing and approving the plans of the ship in accordance with the approved class rules and applicable national standards of the Administration.
6.4 The Registered Naval Architect and Professional Electrical Engineer shall be responsible for designing and drafting the plans and specifications of the vessel in accordance with the principles of naval architecture and the applicable national standards of the Administration and/or published and accepted design standard and practice as those issued by LCS or IACS.

1. OBJIECTIVE
1.1. To ensure that all Philippine Registered Ships comply with the mandatory use of 0.50% m/m Sulphur limit on fuel oil in compliance with MARPOL 73/78, Annex VI on the "Regulations for the Prevention of Air Pollution from Ships", where the Philippine is a party to the Convention; and,
1.2. To promote the effective control of all sources of marine pollution and to take all practicable steps to reduce air pollutions and greenhouse gases from ships.
2. COVERAGE
This Circular shall apply to all Philippine-registered ships, engaging or intending to engage in the domestic or international voyages.
Ports, refineries and fuel suppliers shall comply with the implementation of this Circular.
3. EXEMPTIONS
The Administration may issue an exemption when the:
3.1. Ships is acting to secure the safety of the ship or to save a life at sea; or,
3.2. Ship fitted with an exhaust gas cleaning system(EGCS) experiences unintentional damage resulting in emissions that exceed the Sulphur limit, the ship is expected to take all reasonable steps to reduce emissions. This may include carrying out repair works or switching to compliant fuel; or,
3.3. Ship obtains a Fuel Oil Non-Availability Report (FONAR) due to non-availability of fuel from port of origin. Please see Section X for provision of fuel oil non-availability.
4. DEFINITION OF TERMS
4.1 "Bunker Delivery Note (BD)"refers to the standard document required by Administration, which contains information on fuel oil delivery.
4.2 "Exhaust Gas Cleaning System(EGCS) or Scrubber" refers to the device used to remove particulate matter and harmful components, such as Sulphur Oxides(SOx) and Nitrogen Oxides (NOx) from the exhaust gasses generated as a result of combustion processes in marine engines, to implement pollution control.
4.3 "Fuel Oil Non-Availability Report(FONAR)" refers to a mechanism for a ship to report an inability to comply due to an unforeseen situation to allow the ship to continue its voyage to secure compliant fuel oil and/or debunker non-compliant fuel.
4.4 "Ship Specific Implementation Plan (SIP)" refers to ship's transition plan in preparation for compliance with the use of a complaint fuel.
4.5 "Low Sulphur Fuel Oil (LSFO)" refers to fuel with relatively low viscosity, low density fuel oil and low Sulphur oil with good ignition properties.
4.6 "Phase-in LSFO Implementation Roadmap" refers to the document formulated by the Administration which contains the phase-in implementation plan of all Philippine registered ships in compliance with the Sulphur Cap regulation.
4.7 "Sulphur Emission Control Areas(SECA)" refers to sea areas in which stricter controls are establish to minimize Sulphur emissions from ships.
5. GENERAL PROVISION
5.1. Fuel oil to be used on board ship for propulsion or operation shall have a maximum Sulphur content of 0.50% per mass by mass including all gas, petrol, distillates, residual and blended fuels.
5.2. All Philippine registered ships plying in international trade shall comply with the 0.50%m/m fuel oil Sulphur content limit by 01 January 2020.
5.3. All Philippine registered ships plying in domestic trade shall comply with the 0.50% m/m fuel oil Sulphur content limit by 01 January 2025.
5.4. All Philippine-registered ships in the domestic trade shall develop a Ship Specific Implementation Plan (SIP), based on the attached Phase-in LSFO Implementation Plan. The plan should be complemented with a record of actions taken by the ships in order to be compliant by the applicable date. However, ships that are operating an approved Exhaust Gas Cleaning System(EGCS) shall be able to use and carry fuel oil with a Sulphur content that is more than 0.50% m/m.
5.5. All newly constructed ships covered by this Circular shall comply with the 0.50%m/m fuel oil Sulphur content limit on 01 January 2025.
5.6. All brand new and secondhand ships for importation shall comply with the 0.50% m/m fuel oil Sulphur content limit on 01 January 2025. Non-complaint application for ships importation in accordance with this Circular shall be disapproved by the Administration.
5.7. For the consistent interpretation and implementation of the use of LSFO under MARPOL 73/78 Annex VI, ship owners, operators, charterers and IACS/ROs shall use the approved MEPC.1/Circ.878 and its subsequent amendments on the "Guidance on the development of a ship specific implementation plan for the consistent implementation of the 0.50% Sulphur limit under MARPOL Annex VI."
5.8. This Circular requires the following specific information to be included on the Bunker Delivery Note(BDN), provided to a ship receiving fuels and make available to the administration and other enforcing agencies for monitoring purposes:
a) Name and IMO number (if applicable) of receiving ship;
b) Port;
c) Date of commencement of delivery;
d) Name, address and telephone number of marine fuel oil supplier;
e) Product name(s);
f) Quantity(metric tons);
g) Density at 15℃(kg/m3);
h) Sulphur content(per cent m/m)2; and,
i) A declaration signed and certified by the fuel oil supplier's representative that the fuel oil supplied is in conformity with regulation 18.3 of Annex VI and that the Sulphur content of the fuel supplied does not exceed the limit value prescribed under regulation 14 of MARPOL Annex VI.
5.9. Ships upon complying with this Circular shall properly discharge any fuel that has a Sulphur content of more than 0.50% m/m.
5.10. Non-compliant fuel oil can be de-bunkered to another ship to be carried as cargo, or to an appropriate shipboard or land-based facility.
6. ALTERNATIVE MEASURES
The Administration permits the following alternative measures for compliance:
6.1 Alternative fuel such as liquefied natural gas(LNG), or compliant marine diesel oil that has a Sulphur content of 0.50 per cent m/m or less.
6.2 The use and installation of Exhaust Gas Cleaning System (EGCS) or "scrubber" type shall be approved by the Administration or its ROs.
6.3 Other alternative measure to reduce Sulphur oxide emissions approved by the Administration in accordance with International Maritime Organization(IMO) requirements provided the resulting emissions are equivalent(<0.50% m/m).
7. EXHAUST GAS CLEANING SYSTEM(EGCS) OR SCRUBBER
The Administration permits the use of approved ECGS or Scrubber to comply with the low Sulphur fuel oil limit, provided that the:
7.1 Ships are required to submit to the Administration or its ROs the Schematic Diagram of the EGCS or "scrubber" for verification and approval under MC 2015-07; (Retrofitting or fitting of EGCS may affect the stability, load line or even tonnage of the ship).
7.2 Systems shall be type approved by the Administration or its ROs;
7.3 System is operated in accordance with IMO requirements, including the IMO Resolution MEPC.259(68) on the 2015 Guidelines for Exhaust Gas Cleaning Systems and its subsequent amendments;
7.4 The crew are trained on the use of the system and the system is kept in good working order, with maintenance up to date and monitoring devices fully operational;
7.5 EGCS or scrubber approval documents, as well as operational and maintenance records for the EGCS are maintained on board Philippine-registered ships and made available for inspection by the Flag State and Port State;
7.6 Any EGCS found to be non-compliant with IMO guidelines in any respect(including but not limited to the wash water discharge criteria) shall be prohibited for use in the Philippine waters;
7.7 The following ECGS particulars shall be readily available onboard ship for verification and monitoring:
? Ship name;
? IMO number(if applicable);? Make and model of EGCS; and
? Open-loop, closed-loop or hybrid-type system.
8. MONITORING AND ENFORCEMENT
8.1. The Survey and Certification shall be conducted by the Administration or its ROs.
8.2. The Administration shall rely on documentation, such as bunker delivery notes and oil record books, as well as shipboard procedures. The initial inspection is intended to check if the ship is compliant with its documentation and the low Sulphur fuel requirements.
8.3. The Administration may conduct a more detailed inspection, which may include fuel oil sample analysis, to verify compliance.
9. INFORMATION SHARING RELATED TO NON-COMPLIANCES UNDER THIS CIRCULAR
The information of non-compliant ship or fuel oil supplier shall be reported by the Administration, in coordination with appropriate authorities, to the MARPOL Annex VI GISIS Module(Regulation 11.4).
10. NON-AVAILABILITY OF LOW SULPHUR FUEL OIL
10.1. In the event that compliant fuel oil cannot be obtained, the Administration or its ROs shall request evidence outlining the attempts made to obtain the compliant fuel oil, including attempts made to local alternative sources. Regulations 18.2.4 and 18.2.5 of MARPOL Annex VI then require that the ship notifies its Administration/ROs and other implementing agencies of the port of destination on the inability to obtain compliant fuel oil, with the Party to notify IMO of the non-availability. This notification is commonly referred to as a Fuel Oil Non-Availability Report (FONAR).
10.2. FONAR shall be submitted in the approved form and include evidence of all attempts made by the ship to obtain compliant fuel oil, including attempts to source compliant fuel from alternative local sources.
11. FINES AND PENALTIES
Refer to Marine Circular “MARINA21005-MC-SR-2020-06”.
12. TRANSITORY PROVISIONS
12.1 All Philippine registered ships trading internationally covered by this Circular shall comply on 01 January 2020.
12.2 All new ships to be locally constructed in the Philippine intended for domestic trade shall comply on 01 January 2025.
12.3 Upon effectivity of this Circular all application for importation of ships shall comply with this Circular by 01 January 2025.
12.4 For Philippine-registered ship plying in domestic waters shall have the following phase-in implementation:
.1 All ships shall develop LSFO Ship Specific Implementation Plan (LSFO-SIP) on how companies will comply with the Sulphur limit prior its mandatory compliance date and shall be submitted to the Administration for approval not later than 01 January 2022.
.2 All existing ships may start the retrofitting upon effectivity of this Circular and may voluntarily use the compliant fuel; and,
.3 All ships shall fully comply with this regulation by 01 January 2025.
12.5 All Philippine-registered ships shall be compliant with the IMO 2020 Sulphur Cap by 2025 and beyond.

GUIDELINES ON THE
IMPLEMENTATION FOR THE AIRINGOF THE FOUR (4)-MINUTE VIDEO ON MARINE PLASTIC LITTER
FOR PASSENGER VESSELS (MA 2023-11)
The 4-minute video to prevent and combat
plastic pollution in all passenger vessels shall strictly be implemented:
1.The video must be shown onboard prior
to the departure of the ship;
2.The video shall be primarily in local
dialect in the ports of origin and destination of the vessel, and in English
and Filipino;
3.The video shall contain features for
the proper disposal of plastic onboard the ship which will be played together
with the 4-minute Safety Film under MARINA Memorandum Circular No. 72;
4. Posters regarding the proper
disposal of plastic shall be displayed in noticeableplaces onboard the
ship;
All owners/operators of passenger
vessels of 250 GRT and above covered by these Guidelines shall be given three
(3) months to comply.

MORATORIUM ON THE REQUIREMENTS OFCALCULATIONS FOR THE LIMITATIONS OF SHIPS TO WAVE HEIGHT UNDER MEMORANDUM CIRCULAR NO.SR 2021-04 (MA 2023-12)
The Sec V.2 of MCSR 2021-04 entitled “Revised Rules and Regulations on Intact Stability Requirement for Philippine-Registered Ships” which requires the calculations for the limitations of ships to wave height that is capable to operate is hereby DEFERRED until further notice.
This Advisory shall take effect from May 10,2023 and shall remain in force until withdrawn or lifted by the Administration.
All new ships to be built and ships to be imported covered by this advisory for domestic operation in the Philippines shall meet the subdivision and damage stability requirements specified by this advisory and relevant Circulars.COVERAGE
1. Cargo ships of 80 m in length (L) and above;
2. Oil tankers of 400 GT and above;
3. Chemical tankers of 400 GT and above;

GUIDELINES FOR THE ISSUANCE OF LOAD LINE
CERTIFICATE FOR FISH CARRIER IN DOMESTIC OPERATION (MA 2023-13)
In line with the implementation of MARINA Memorandum Circular SR 2021-02 entitled “Revised Rules and Regulations on Load Line Survey, Assignment, Marking and Certification for Philippine-Registered Ships”, clarification is hereby made on requiring load line for Fish Carriers and shall abide by the following rules:
The Load Line Certificate shall be issued for a period not exceeding five (5) years validity with reckoning dates:
For newly constructed ships, the reckoning for the issuance of Load Line Certificate shall be the date of the completion of the initial surveys of Load Line and Ship Safety survey/inspection;
When the renewal surveys of Load Line and Ship Safety survey/inspection are completed within three (3) months before the expiry date of the existing Load Line Certificate, the new Load Line Certificate shall be valid from the date of completion of renewal surveys of Load Line and Ship Safety survey/inspection to a date not exceeding 5 years from the date of expiry of the existing Load Line Certificate;
When the renewal surveys of Load Line and Ship Safety survey/inspection are completed after the expiry date of the existing Load Line Certificate, the new Load Line Certificate shall be valid from the date of completion of renewal surveys to a date not exceeding 5 years from the date of expiry of the existing Load Line Certificate.
When the renewal surveys of Load Line and Ship Safety survey/inspection are completed more than three (3) months before the expiry date of the existing Load Line Certificate, the new Load Line Certificate shall be valid from the date of completion of renewal surveys of Load Line and Ship Safety survey/inspection to a date not exceeding 5 years from the date of completion of renewal surveys of Load Line and Ship Safety survey/inspection.
Due to the nature of the operations of Fish Carriers in domestic fishing, instead of annual survey, the Load Line survey shall be conducted only during its mandatory dry-docking of the five year dry-docking period and the expiry of its Load Line Certificate.
No extension shall be granted after the five (5) years validity of Load Line Certificate.
if the Load Line Certificate is issued for a period of less than five (5) years, the Administration may extend the validity of the Load Line Certificate beyond the expiry date to the maximum period specified in paragraph 1, provided that the applicable Load Line surveys shall be carried out as appropriate.
This Advisory shall take effect immediately and shall remain in force until appropriate amendments of MARINA MC SR 2021-02 have been issued expressly revoking or repealing this Advisory.

1. OBJECTIVES
1.1 Prevent the utilization of harmful anti-fouling paints and other anti-fouling systems that contain harmful substances in al Philippine-Registered Ships compliant with the AFS Convention;
1.2 Promote and establish the effective mechanism to control and prevent the potential future use of other harmful substances in anti-fouling systems on ships in order to protect the marine environment and human health from its adverse effects; and,
1.3 Promote the effective control of all sources of marine pollution and to take all practicable steps to prevent pollution of the sea.
2. COVERAGE
2.1 All MARINA-registered Shipbuilding/Ship Repair/ Boatbuilding/Boat Repair/ Shipbreaking entities;
2.2 All Philippine-registered domestic and/or international going ships, or ships operating under the Philippines flag;
2.3 All foreign registered ships entering the Philippine maritime jurisdicion; and,
2.4 All ships entering a port, shipyard, or offshore terminal in the Philippines, but do not fall within items nos.2.2 & 2.3.
This Circular shall not apply to any warships, naval auxiliary, or other ships owned or operated by the Philippines and used, for the time being, only on government non-commercial service. Such ships shall, however, endeavor to ensure compliance with these regulations insofar as is reasonable and practical.
3. GENERAL PROVISION
3.1 All ships covered by this Circular shall take effective measures to strictly comply with the requirements as specified in Annex 1, Controls on Anti-Fouling Systems of the International Convention on the Control of Harmful Anti-Fouling Systems on Ships (AFS Convention) and MARINA Advisory 2015-20, that ships shall not apply or re-apply Organotin Compounds which act as biocides in anti-fouling system..
3.2 The application, re-application, installation, or use of HARMFUL anti-fouling systems on ships shall be PROHIBITED.
3.3 The application, re-application, installation or use of harmful anti-fouling systems on ships while in any port, shipyard, or offshore terminal within the Philippines shall be RESTRICTED.
3.4 Upon Completion of dry-dock of the ships, the MARINA-Registered Shipbuilding/Ship Repair/Boatbuilding/Boat Repair Entities shall issue and submit to the Administration Certification of Marine Paint attesting that the paints used on the ships are compliant with Section V.1.
3.5 All ships of 24 meters in length and above and/or 400GT and above shall be issued with Anti-Fouling System(AFS) Certificate and Records of Anti-Fouling System and shall at all times carry onboard a copy of the said certificate.
3.6 All ships not issued with AFS Certificate shall at all times carry onboard an AFS Declaration accompanied with the Certification of Marine Paints from the Shipyard/Boatyard where it was last dry-docked.
3.7 All ships covered by this Circular using non-compliant anti-fouling system controlled under Annex 1 of the AFS Convention shall undergo repair or replacement with a compliant AFS.
3.8 All foreign registered ships entering the Philippines maritime jurisdiction, as well as ships that enter a port, shipyard, or offshore terminal in the Philippines shall at all times carry onboard a copy of the International AFS Certificate.
3.9 Ships covered by this Circular bearing an anti-fouling system which is controlled through an amendment to Annex 1 following entry into the force of the AFS Convention may retain that system until the next scheduled renewal of that system, but in no event for a period exceeding
6 months following application.
3.10 All MARINA Registered-Shipyards/Boatyards/Shipbreaking yards are required to ensure that any waste from the application or removal of an anti-fouling system is collected, handled, treated and disposed of in a safe and environmentally sound manner to protect human health and the environment.
4. SURVEY AND CERTIFICATION
4.1 The Administration or its Recognized Organization (RO) covered under MC 2018-01 shall carry out AFS survey during any of the following conditions:
4.1.1 Newbuilding of ships;
4.1.2 Dry-docking survey of the ship whenever an anti-fouling system is changed or replaced;
4.1.3 Major conversion, alteration or modification of ships affecting anti-fouling system; and/or,
4.1.4 Repairs affecting approximately 25% of more of the anti-fouling system.
4.2 The Administration or its RO shall issue an Anti-Fouling System (AFS) Certificate after successful completion of a survey in accordance with Section V.1.
4.3 Record of Anti-fouling Systems shall indicate the following Details of Anti-Fouling:(attached as Annex 1)
(a) Type of AFS used;
(b) Date of Application of AFS;
(c)Name of Company/ies and facility/ies /location/s where the AFS was applied;
(d)Name/s of AFS manufacturer/s;
(e)Name/s and color/s of AFS;
(f)Active ingredient/s and their Chemical Abstracts Service Registry Number or the CAS number,
(g) Type/s of sealer coat, if applicable;
(h) Name/s and color/s of sealer coat applied, if applicable; and
(i) Date of application of sealer coat.
4.4 The Administration or its RO shall strictly re-issue/update the Records of AFS of ships whenever the AFS system is changed or replaced.
4.5 Compliance Monitoring for Domestic Ships
The Administration shall undertake periodic, random inspection of Philippine-Registered ships calling any Philippines ports to ensure compliance with the Circular.
Philippine-Registered ships trading overseas shall be subject to survey/inspection under the oversight function of the Administration.
5. BRIEF SAMPLING OF AFS ON SHIPS
Unless there are clear grounds of violation of this circular, a brief sampling of the ship's anti-fouling system shall be made by the Authority. Sampling shall be in accordance with resolution MEPC.104(49) or the "Guidelines for Brief Sampling of Anti-fouling Systems on Ships" provided that it does not affect the integrity, structure, or operation of the anti-fouling system.
However, the time required to process the results of such sampling shall not be used as a basis for preventing the movement and departure of the ship.
6. DOCUMENTARY REQUIREMENTS
6.1 Letter of Application;
6.2 Drydocking Certificate;
6.3 Proof of purchase of Marine Paint;
6.4 Certification of Marine Paint from the shipyard/boatyard;
6.5 Technical Data Sheet of manufacturer and Material Safety Data Sheet(MSDS) of the used paint;
6.6 Original AFS Certificate(for replacement/reapplication of AFS); and
6.7 Record of AFS(for replacement/reapplication of AFS).
7. VALIDITY OF AFS CERTIFICATE
The AFS Certificate shall remain valid provided that the Record of AFS is updated whenever the AFS system is changed or replaced.
8. FEES AND CHARGES/ FINES & PENALTIES
Refer to Marine Circular “MIA21011-MC-SR-2020-04”.
9. TRANSITORY PROVISION
9.1 New ships for construction under this Circular shall comply upon effectivity of this Circular.
9.2 Existing ships covered by this Circular shall comply during the next scheduled dry-docking period.
9.3 All MARINA-Registered Shipyards/Ship Repair/Boatbuilding/ Boat Repair/ Shipbreaking entities shall immediately comply upon effectivity of this Circular.

1. OBJECTIVES
1.1. To ensure that all Philippine Registered Ships plying in international trade, shall comply with the International Convention for the Control and Management of Ships' Ballast Water and Sediments,2004(BWM Convention), as amended; and,
1.2. To promote the effective prevention of spread of harmful aquatic organisms from other region to Philippine waters to avoid damage to the country's marine environment from ballast water discharge, by minimizing the uptake and subsequent discharge of sediments and organisms.
2. COVERAGE
This Circular shall apply to all persons, corporations, partnerships, firms and entities acquiring or operating ships of 400 gross tonnage and above.
3. EXEMPTIONS
The provisions of this Circular shall not apply to:
3.1. Ships not designed or constructed to carry ballast water;
3.2. Ships operating exclusively in waters under the jurisdiction of the Philippines, unless the administration and other competent authorities at a later date determine that the discharge of ballast water from all or some of such ships would impair or damage the environment, human health, property or resources in the country;
3.3. Ships operating under the authority of regional agreements shall be subject to provisions of relevant regional agreements;
3.4. Philippine registered ships operating in waters under the jurisdiction of another State, subject to the authorization of the State for such exclusion;
3.5. Ships operating exclusively in Philippine waters and on the high seas, except for ships not granted authorization pursuant to sub paragraph(4);
3.6. Pleasure craft that are less than 50 meters in overall length and that have a maximum ballast water capacity of 8 cubic meters;
3.7. Ships engaged in search and rescue operations that are less than 50 meters in overall length and that have a maximum ballast water capacity of 8 cubic meters;
3.8. Ships that carry permanent ballast water in sealed tanks such that it is not subject to release; and.
3.9. Any warship.
4. EXCEPTIONS
The Administration allows the following exceptions in emergency situation provided that all reasonable precautions have been taken before and after the occurrence of the damage or discovery of the damage or discharge for the purpose of preventing or minimizing the discharge; and unless the owner, company or officer in charge willfully or recklessly caused damage:
4.1. The uptake or discharge of ballast water and sediments necessary for the purpose of ensuring the safety of a ship in emergency situations or saving life at sea; or
4.2. The accidental discharge or ingress of ballast water and sediments resulting from damage to a ship or its equipment; or
4.3. The uptake and discharge of ballast water and sediments when being used for the purpose of avoiding or minimizing pollution incidents from the ship; or
4.4. The uptake and subsequent discharge on the high seas of the same ballast water and sediments; or
4.5. The discharge of ballast water and sediments from a ship at the same location where the whole of that ballast water and those sediments originated and provided that no mixing with unmanaged ballast water and sediments from other areas has occurred. If mixing has occurred, the ballast water taken from other areas is subject to ballast water management in accordance to this Circular.
5. GENERAL PROVISION
5.1. All ships covered by this Circular shall take effective measures to strictly comply with the provisions of the Ballast Water Management Convention.
5.2. All ships covered by this Circular plying in Philippine waters are required to carry at all times the International Ballast Water Management Certificate(IBWMC) for ships plying the flag of countries party to the Convention;
5.3. Each ship covered by this Circular shall have on board and implement a Ballast Water Management Plan. Such plan shall be submitted to and approved by the Administration or its Recognized Organization(RO), taking into account the Guidelines developed under the BWM Convention.
5.4. Each ship covered by this Circular shall have on board a Ballast Water Record Book that may be an electronic record system, or that may be integrated into another record book or system.
5.5. All foreign registered ships entering the Philippines maritime jurisdiction, as well as ships that enter a port, shipyard, or offshore terminal in the Philippines shall at all times carry onboard a copy of the IBWMC.
5.6. Ships for new construction covered by this Circular shall submit to the Administration or its RO the installation plan for Ballast Water Treatment System (BWTS) incorporated to the engine room arrangement plan for verification and shall be subjected for approval under MC 2015-07.
5.7. Existing ships covered by this Circular shall be required to submit to the Administration or its RO the Modified Engine Room Arrangement Plan incorporating the BWTS for approval subject to actual verification and issuance of Construction Certificate indicating the installation of the BWTS under MC 2015-07. In case, the stability of the ship is affected by the said fittings, a re-inclining experiment test, re-calculation of freeboard and other related issuances shall be required by the Administration.
5.8. Ships covered by this Circular that use alternative methods for ballast water management which is for research and development purposes only shall be required to submit to the Administration or its RO the Schematic Diagram of the BWMS for verification and shall be subject for approval under MC 2015-07.
5.9. All Philippine imported ships arriving in the Philippines not equipped with on-board ballast water treatment system, shall discharge its ballast water in designated ballast water exchanges areas only.
6. SPECIFIC PROVISIONS
Ships covered by this Circular shall comply with and have in place the following requirements on board:
6.1. BALLAST WATER MANAGEMENT STANDARDS
6.1.1 All discharges of ballast water from ships shall be conducted through ballast water management using any or a combination of the following:
.1 Ballast Water Exchange(D1);
.2 Use of BWM reception facilities; and,
.3 On-board Ballast Water Treatment System(D2).
6.1.2 The Administration or its RO shall allow ships to discharge ballast water only in accordance with the following Ballast Water Performance Standards as prescribed by the Ballast Water Management Convention:
Standards Specifications
1. D1 Standard
(Ballast Water Exchange)
The D-1 standard requires ships to exchange their ballast water based on the following: a) in open seas, away from coastal areas at least 200
nautical miles from the nearest land and in water at least 200 meters deep or in sea areas set up by the Administration and other competent authority; and, b) at least 95% of water by volume is exchanged far away from the coast.
Note: Ships conducting ballast water exchange shall not be required to comply with the regulations if the Master reasonably decides that such exchange would threaten the safety or stability of the ship, its crew, or its passengers because of adverse weather, ship design or stress, equipment failure, or any other extraordinary condition.
2.D2Standard
(Ballast Water Treatment System)
The D-2 standard specifies that ships can only discharge ballast water that meets the following criteria: a) less than 10 viable organisms per cubic meter which are greater than or equal to 50 micrometers in minimum dimension;
b)less than 10 viable organisms per milliliter which are between 10 micrometers and 50 micrometers in minimum dimension;
c)less than 1 colony-forming unit (cfu) per 100 milliliters of Toxicogenic Vibrio cholera;
d)less than 250 cfu per 100 milliliters of Escherichia coli; and
e)less than 100 cfu per 100 milliliters of Intestinal Enterococci.
Note: Ballast Water Treatment System (BWTS) to be installed in ships shall be approved by the Administration or ROs in accordance with the BWM Convention, and must be safe for the ship, its equipment and its crew.
6.2 BALLAST WATER MANAGEMENT PLAN
The Ballast Water Management Plan shall be specific to each ship covered by this Circular and shall contain the following details:
6.2.1 safety procedures for the ship and the crew associated with ballast water management;
6.2.2 description of the actions to be taken to implement the ballast water management requirements and supplemental ballast water management practices as set forth in this rules and regulation;
6.2.3 the procedures for the disposal of sediments at sea; and, to shore;
6.2.4 include the procedures for coordinating shipboard ballast water management that involves discharge to the sea with prior written clearance from the authorities;
6.2.5 designating the officer on board in charge of ensuring that the plan is properly implemented;
6.2.6 contain the reporting requirements for ships provided for under this circular; and,
6.2.7 be written in English.
6.3 BALLAST WATER RECORD BOOK
6.3.1 Each ship covered by this Circular shall have on board a Ballast Water Record Book that may be an electronic record system, or that may be integrated into another record book or system and, which shall at least contain the following information:
.1 Name of Ship;
.2 IMO Number;
.3 Gross Tonnage Flag;
.4 Total Ballast Water capacity(in cubic meters);
.5 The ship is provided with a Ballast Water Management plan; and,
.6 Diagram of ship indicating ballast tanks.
6.3.2 Ballast Water Record Book entries shall be maintained on board the ship for a minimum period of two years after the last entry has been made and thereafter in the Company's control for a minimum period of three years.
6.3.3 In the event of the discharge of Ballast Water pursuant to Section IV and V or discharge of ballast water to a reception facility or in the event of other accidental or exceptional discharge of Ballast Water not otherwise exempted by this Circular, an entry shall be made in the Ballast Water Record Book describing the circumstances of, and the reason for, the discharge.
6.3.4 The Ballast Water Record Book shall be kept readily available for inspection of the Administration or its RO at all reasonable times.
6.3.5 Each operation concerning Ballast Water shall be fully recorded without delay in the Ballast Water Record Book. Each entry shall be signed by the officer in charge of the operation concerned and each completed page shall be signed by the Master.
6.3.6 The entries in the Ballast Water Record Book shall be written in English.
7. SURVEYS AND CERTIFICATION
7.1. The Administration or its Recognized Organization(RO) covered under MC 2018-01 shall carry out BWM survey during any of the following conditions:
.1 new constructed ships;
.2 Installation of Ballast Water Treatment System for existing ships;
3 implementation of Ballast Water Management system; and/or,
.4 request for exemption from this Circular.
7.2. The Administration or its RO shall approve the BWM Plan after successful completion of evaluation in accordance with this Circular.
7.3. The Administration or its RO shall issue an International Ballast Water Management(BWM) Certificate after successful completion of a survey in accordance with this Circular.
7.4. The Administration or its RO and other competent authorities can conduct inspection of the ballast water record book, and/or sampling of the ship's ballast water;according to the guidelines under the BWM Convention.
7.5. The Administration or its RO shall strictly re-issue/update the Records of BWM of ships.
7.6. The Administration shall undertake periodic,random inspection of Philippine-Overseas Registered ships calling any Philippines ports to ensure compliance with this Circular.
7.7. Philippine-Registered ships trading overseas shall be subject to survey/inspection under MC MS-2020-02 on the oversight function of the Administration.
8. TRANSITORY PROVISION
8.1. New ships covered by this Circular constructed on or after 8 September 2017, shall be required to meet the Regulation D-2discharge standard from the date they are put into service.
8.2. Ships covered by this Circular constructed before 8 September 2017shall comply with the Regulation D-2 standard by either the first or second five-year renewal survey of the vessel associated with the International Oil Pollution Prevention Certificate (IOPP) under the International Convention for the Prevention of Pollution from Ships(MARPOL) Annex l.
8.3. Ships covered by this Circular shall comply with the Regulation D-2 standard by their first renewal survey date, when the first renewal survey takes place:
.1 on or after 8 September 2019; or,
.2 a renewal survey has been completed on or after 8 September 2014, but prior to 8 September 2017.
8.4. Ships covered by this Circular shall comply with the Regulation D-2standard by their second renewal survey date, when the first renewal survey takes place:
.1 after 8 September 2017; and,
.2 before 8 September 2019.
8.5. From 08 September 2017, all existing ships shall meet at least the D-1(ballast water exchange) standard.
Note: ships may also choose to install a ballast water management system or otherwise meet the D-2(discharge) standard but this is not mandatory until the corresponding compliance date.
8.6. Philippine-registered domestic ships maybe required to comply with this Circular if the Administration and other competent authorities at a later date determine that the discharge of ballast water from all or some of such ships would impair or damage the environment, human health, property or resources in the country.

survey, assignment, marking and certification for Philippine registered ships
Memorandum circular no. SR 2021-02
These rules and regulation shall apply to
all Philippine-registered ships except for the following:
Ships less than 15 meters in length;
Ships of war;
Recreational boats under MC DS2019-01, not
engaged for commercial use;
Fishing vessels except fish carriers;
Government ships (not engaged in commercial
operation); and
Motor bancas with outrigger regardless of
length
1.
The international Convention on
load line(ICLL) 1966, as amended, is hereby adopt to apply to all Philippine-registered
ships 15 meters and above in length whether engaged in international or
domestic voyage.
2.
Ships covered by this circular
shall not proceed to sea on domestic or international trading unless it has
been surveyed, marked and issued a Load line certificate by the Administration
for domestic trade or its Recognized Organization for international trade in
accordance with these rules and regulations.
3.
The “RP” or Republic of the
Philippines, whom the load lines are assigned, shall be indicated alongside the
load line ring above the horizontal line which passes through the center of the
ring, or above and below it. This mark shall consist of not more than four
initials to identify the Authority’s name, each measuring approximately 115 mm
in height and 75mm in width.

In cases where an Administration’s
recognized organization undertake the survey, assignment, and marking of load line,
it shall guarantee the completeness and efficiency of the survey, inspection
and marking, subject to the verification and approval by the Administration.
The Administration’s recognized organization shall submit a copy of survey
report to ensure compliance with the convention and this circular, with the concerned
Administration’s recognized organization assuming the responsibility to ensure
strict observance of this requirement in compliance with MC MS 2020-01.
6.
In cases of measurement of less
than 24 meters but not less than 15 meters, the value of 200 mm in the
convention’s tabular freeboard for 24 meters in length shall also adopted down
to 15 meters in length and including the correction computation as indicated in
the ILLC 66.
7.
No extension shall be granted
after the five (5) years validity of load line certificate. However the
administration may extend the validity of the certificate until the completion
of its voyage to the port where the ship is to be surveyed.
8.
Other safety certificate(s)
shall not be issued /renewed if the ship has no load line certificate or if the
load line certificate cease to be valid.
9.
If the load line certificate
cease to be valid or cancelled either by virtue of Article 19, Sec.3 of the
convention, as officially ordered by the Administration, the other safety
certificate(s) issued to the ship is/are deemed automatically suspended and the
ship is under a “no sail condition”.
10.
Upon completion of the needed
surveys, calculation, assignments, marking, etc., whether undertake by the Administration
or its Recognized Organization, and submission of all requirements, the full
term load line certificate shall be issued by the Administration for ships in
domestic trade or its Recognized Organization for ships in international trade.
However, a copy of the international load line certificate and load line survey
report shall be submitted to the Administration.
11.
Philippines-registered ships
shall have on board and displayed in conspicuous place a Marina original copy
of the load line certificate.

Revised rules and regulations on the
tonnage measurement of Philippine-registered ships
Memorandum circular no. SR 2021-01
The circular shall cover all Philippine-registered
ships or to be registered under Philippine flag, engage in both domestic and
international operations, except for the following:
Ships of war;
Government ships not engage in commercial
trade;
Recreational boats under MC DS2019-01 and
its subsequent amendments;
And;
Fishing vessels 3GT and below;
1.
All Philippine-registered ships
are admeasured/re-admeasured in accordance with the International Convention on
Tonnage Measurement of ships 1969, as amended, and other applicable rules and regulation
as state on this circular.
2.
All Philippine-registered ships
covered by this Circular whether engaged in domestic or international
operations must always have in possession on board a Tonnage Measurement
Certificate issued by the administration for ships in domestic operation or an
international Tonnage Measurement Certificate issued by a Recognized
Organization foe ships in international operation.
3.
All Philippine-registered ships,
except for 15 meters and below in length and motorbancas with outriggers shall
be admeasured in accordance with the applicable provision of the International
Convention on Tonnage Measurement of ships 1969, as amended. For Philippine-registered international
ships, they can be admeasured and certified by a Recognized Organization, but
the international Tonnage Measurement certificate shall adopt such calculations
and be issued by the administration.
4.
Other safety certificates shall
not be issued /renewed to a ship which has no Tonnage Measurement Certificate,
or if such Certificate ceases to be valid.
5.
I f the Tonnage Measurement
Certificate is invalidated by the administration or its Recognized Organization after due process,
the other safety certificates issued to such ship shall automatically be
suspended, and the ship shall be under “ no sail condition”.

In line with the initiative of the
Administration to promote the effective control of all sources of marine
pollution and to take all practicable steps to prevent pollution of the sea and
eliminate the spread of non-indigenous species and in relation with IMO Resolutions
MSC.215(82), MSC 288(87) and MSC 289(87), it is hereby directed to strictly
comply with the following in the precautionary measures on protective coating and
corrosion prevention of ship's hull and other components in the Philippine
waters in order to protect the marine environment and human health from its
adverse effects:
a. For application of regular coatings: The
ship's hull can be protected by applying
a two-part coal-tar epoxy and a vinyl tar
coat or any equivalent/higher grade coating provided that these material does
not contain Tributyltin (TBT) and/or similar compounds in compliance to MARINA
MC SR 2020-04 "Rules and Regulations on the Application of Anti-Fouling
Paints and Systems in Ships in compliance to the International Convention on
the Control of Harmful Anti-Fouling Systems in Ships (AFS Convention)";
b. When building and replacing parts, use
stainless steel or plastic as these materials are more resistant to corrosion.
Also, certain titanium and nickel alloys or any equivalent/higher grade
materials can be used; and
c. Also, protect electrical circuits by
placing waterproof insulation around cable connectors
Furthermore, as not to compromise safety
and further ensure safe operation of all ships and making sure the ship's hull
is in good shape and condition, this Authority is directing all concerned to observe
and maintain records of the following:
a. Regular Hull maintenance routine which
includes inspecting the hull, rudder, and keel damage and arranging for any
needed repairs immediately, and checking the condition of the teak and renewing
it if necessary;
b. Annual Hull checks which include the
need to be hauled out annually for zinc replacement, anti-fouling and (if
necessary) repainting.

This advisory introduces the requirements of new SOLAS regulation 11-1/3-12 on "Protection against Noise". for vessels flying Philippine flag, the application and technical requirements are consistent with the requirements of “the Code on noise levels on board ships”.
The administration of Philippines considered that the issues pertaining to noise level shall be included in the Safety Management System and Seafarers shall be briefed in the hazards of high level and long duration of noise exposure.

a. all watertight decks and bulkheads are
inspected periodically;
b. Ensure watertight doors, hatches and
ramps are securely closed prior to departure and regularly inspected during its
entire voyage;
c. Ensure compartments, manholes, air pipes
and other external hull structures fitted with gaskets, hinge covers sealing,
surfaces and securing mechanisms are regularly inspected and properly
maintained;
d. All cargoes should be properly stowed,
lashed and secured in accordance with ship's approved Cargo Securing Manual
(CSM);
e. Passage lanes must be kept safe and free
from any material obstructions.
f. Overweight trucks/rolling cargoes shall
not be allowed onboard.
g. Safe procedure on loading, unloading and
stowage should be incorporated in the SMS Manual of the ship and properly
implemented.

1.目标

2. 适用范围

3. 一般规定
3.1 船舶建造、改装或改装前,应获得管理部门的造船/造船许可证。
3.2 在MARINA注册的造船厂应负责确保建造或改装的船舶满足批准的计划、规范和所有适用标准、规则和条例。
3.3 提交给管理部门的所有船舶建造、改造或改装的计划和施工规范应由注册造船师盖章和签字。而电气计划应根据MC 2015-07要求由电气专业工程师签字和盖章。
3.4 管理部门在履行其监督和监测职能时,在船舶建造、改造或改装阶段时,应根据经修正的MC 165要求或MC 2018-01相关要求,对当地船级社或认可组织所进行的检验进行监督。
3.5 采用木材建造、覆盖/涂覆FRP或采用类似结构的船舶不得视为使用复合材料。
3.6 油船不允许使用复合材料。
3.7 商用客船应采用单壳、双壳2型或三壳2型设计,应足以承受恶劣天气和海况。考虑到航行区域,船舶的操作限制应反映在操作权限中。
3.8 船体(无论是单壳还是多壳)、上部结构、甲板室、机壳、通道和任何其他结构和设备的强度和结构应足以承受恶劣天气和海况。
3.9 在签发安全证书之前,应向管理部门提交船级证书。当地船级社或IACS成员应确定并识别船级证书中由管理部门批准的航行区域船舶的操作限制。
4. 特殊规定
4.1 对于船长不超过24米的复合材料的船舶
4.1.1 所有使用本通告涵盖的长度不超过24米的复合材料的船舶,在建造、改造或改装之前,应按照经批准的船级规则和管理局适用的国家标准,向管理局提交所有必要的船舶平面图和规范(如ISO12215或其同等菲律宾国家标准(PNS))。
4.1.2 所有使用本通告涵盖的长度不超过24米的复合材料的船舶,在注册和颁发法定证书(如适用)之前,应在建造、改造或改装期间接受管理部门的定期检查/检验。
4.2对于船长超过24米的复合材料的船舶
4.2.1 本通告涵盖的所有使用长度超过24米的复合材料的船舶应由当地船级社或IACS成员进行入级。在提交给管理部门之前,与船舶建造、修改或改装相关的平面图、图纸、尺寸计算以及其它任何修订应经当地船级社或IACS成员审查和批准。
4.2.2 当地船级社或IACS成员应负责确保船舶按照管理部门批准的船级社规范和管理部门适用的国家标准进行建造、改造或改装以及适当的维护。
4.2.3 当地船级社或IACS成员的验船师应在船体、机械和设备的建造和组装期间进行检验。
5. 文件要求

6.3 根据批准的船级规则和管理部门适用的国家标准,当地船级社/IACS成员应负责审查和批准船舶计划。
6.4 注册造船工程师和专业电气工程师应根据造船原则和管理部门适用的国家标准和/或当地船级社/IACS成员发布和接受的设计标准和实践,设计和起草船舶平面图和规格。
7. 收费规定/惩罚规则

关于MCSR2020-03(《使用复合材料的船舶建造与认证规则》)和MCMS 2023-01(《适用于休闲船的检验、干坞测试和证书发放的修订规则与条例》)实施的澄清说明
1.所有24米及以下的休闲船只不得受MC SR 2020-03条款的约束;并且
2.根据MC MS-2023-01第IV.9节的规定,长度为20米及以下的休闲船只的干坞证书,可由注册所有人、游艇俱乐部或服务提供者以及/或其他实施了必要工作以保持船只适航状态的机构颁发,同时应经过适当公证以确保法律效力。

油船、油驳及MRINA Circular (No.2010-01和No.104)覆盖船型的入级要求
根据Marina Circular No.2010-01的要求,所有的油船、租赁的驳船都应为IACS船级。现有的油船如无IACS船级,应获得MARINA认可船级社的船级。本地新建500总吨以下的船应获得MARINA认可船级社的船级。
根据MARINA Memorandum Circular No.104的要求,该通函适用的所有船舶,除了个人自用的摩托艇、木质船舶以及渔船,都应在投入运营前获得MARINA认可国际船级社在本地的分支机构的船级。船级检验报告应提交MARINA。

1.目标

1.2.促进对所有海洋污染源的有效控制,并采取一切切实可行的措施减少船舶造成的空气污染和温室气体。
2.适用范围
本通告适用于所有从事或打算从事国内或国际航行的菲律宾注册的船舶。
港口、炼油厂和燃料供应商应遵守本通知的实施。
3.豁免
在下列情况下,行政当局可发布豁免:
3.1.船舶为确保船舶安全或拯救海上人命而采取行动;或
3.2.装有废气净化系统(EGCS)的船舶遭受意外损坏,导致排放物超过硫限值,预计船舶将采取一切合理措施减少排放物。这可能包括进行维修工作或更换符合要求的燃油;或
3.3.由于原产港未提供燃油,船舶获得燃油不可用报告(FONAR)。关于燃油不可用的规定,请参见第10条规定。
4.术语定义
4.1“燃料库交货单(BD)”是指管理部门要求的标准文件,其中包含燃料油交货信息。
4.2“废气净化系统(EGCS)或洗涤器”是指用于从船用发动机燃烧过程产生的废气中去除颗粒物和有害成分,如硫氧化物(SOx)和氮氧化物(NOx),以实施污染控制的装置。
4.3“燃油不可用性报告(FONAR)”是指船舶报告由于不可预见的情况而无法遵守的机制,以允许船舶继续其航程,以获得符合要求的燃油和/或清除不符合要求的燃油。
4.4“船舶特定实施计划(SIP)”是指为遵守投诉燃料的使用而准备的船舶过渡计划。
4.5“低硫燃油(LSFO)”是指粘度相对较低、密度较低的燃油和具有良好点火性能的低硫燃油。
4.6“分阶段实施LSFO路线图”是指由管理部门制定的文件,其中包含所有菲律宾注册船舶的分阶段实施计划,以符合硫上限规定。
4.7“硫排放控制区(SECA)”是指为尽量减少船舶硫排放而建立更严格控制的海域。
5.一般规定
5.1.船上用于推进或操作的燃油的最大含硫量应为0.50%(按质量计),包括所有气体、汽油、馏出物、残余燃料和混合燃料。
5.2.在2020年1月1日之前,所有在国际贸易中航行的菲律宾注的册船舶应符合0.50%m/m燃油含硫量限值。
5.3.在2025年1月1日之前,所有从事国内贸易的菲律宾注册船舶应符合0.50%m/m燃油含硫量限值。
5.4.所有在菲律宾注册的从事国内贸易的船舶应根据随附的LSFO实施计划制定船舶特定实施计划(SIP)。该计划应附有船舶所采取行动的记录,以便在适用日期前符合要求。但是,运行经批准的废气净化系统(EGCS)的船舶应能够使用和运输含硫量超过0.50%m/m的燃油。
5.5.本通告涵盖的所有新建造船舶应在2025年1月1日起符合0.50%m/m燃油含硫量限值。
5.6.自2025年1月1日起,所有进口的全新和二手船舶应符合0.50%m/m燃油含硫量限值。根据本通告提出的进口船舶Non-complaint申请将不获管理部门批准。
5.7.为了一致解释和实施《73/78年防污公约》附则六中低硫燃油的使用,船舶所有人、经营人、租船人和IACS/ROs应使用批准的MEPC.1/Circ.878及其后续修正案关于“制定船舶特定实施计划以实施《防污公约》附件六规定的0.50%硫限量的指南”
5.8.本通告要求在燃料库交付通知单(BDN)中包含以下具体信息,该通知单应提供给接收燃料的船舶,并提供给管理部门和其他执法机构,以便进行监督:
a)接收船舶的名称和IMO编号(如适用);
b)港口;
c)交付开始日期;
d)船用燃油供应商的名称、地址和电话号码;
e)产品名称;
f)数量(公吨);
g)15℃时的密度(kg/m3);
h)硫含量(百分之m/m);以及,
i)一份由燃油供应商代表签署和认证的声明,声明所供应的燃油符合《防污公约》附则六第18.3条的规定,且所供应燃油的含硫量不超过《防污公约》附则六第14条规定的限值。
5.9.船舶在遵守本通告后,须妥善排放含硫量超过0.50%m/m的任何燃料。
5.10.不符合要求的燃油可以卸下燃料,运到另一艘船上作为货物,或运到适当的船上或陆上设施。
6.替代措施
主管当局允许采取以下替代措施来遵守:
6.1替代燃料,如液化天然气(LNG),或含硫量为0.50%m/m或以下的合规船用柴油。
6.2废气净化系统(EGCS)或“洗涤器”类型的使用和安装应获得管理部门或其ROs的批准。
6.3主管当局根据国际海事组织(IMO)要求批准的其他减少氧化硫排放的替代措施,前提是产生的排放量相当(<0.50%m/m)。
7.废气净化系统(EGCS)或洗涤塔
主管当局允许使用经批准的ECG或洗涤器,以符合低硫燃油限值,前提是:
7.1根据通告MC 2015-07,要求船舶向管理部门或其ROs提交EGCS或“洗涤塔”的示意图,以供验证和批准(改装或安装EGCS可能会影响船舶的稳定性、载重线甚至吨位)。
7.2系统应为管理部门或其ROs批准的类型;
7.3系统按照IMO要求运行,包括IMO关于2015年废气净化系统指南的MEPC.259(68)号决议及其后续修正案;
7.4船员接受了系统使用培训,系统保持良好的工作状态,最新的维护和全面运行的监控设备;
7.5EGCS或洗涤塔的批准文件以及EGCS的操作和维护记录保存在菲律宾注册的船舶上,并提供给船旗国和港口国检查;
7.6任何被发现在任何方面(包括但不限于冲洗水排放标准)不符合IMO指南的EGCS均应禁止在菲律宾水域使用;
7.7船上应随时提供以下ECGS详情,以供验证和监测:
?船名
?国际海事组织编号(如适用);?EGCS的制造和模型;和
?开环、闭环或混合型系统。
8.监测和执行
8.1.检验和发证应由管理部门或其ROs进行。
8.2.管理部门应依据文件,如燃料库交货通知单和油类记录簿,以及船上程序。初步检查旨在检查船舶是否符合其文件和低硫燃料要求。
8.3.管理部门可能会进行更详细的检查,包括燃油样品分析,以验证合规性。
9.与本通知项下不合规行为相关的信息共享
管理部门应与有关当局协调,依据MARPOL附则六GISIS模块(条款11.4)要求,报告不合规船舶或燃油供应商的信息。
10.低硫燃油供应不足
10.1.如果无法获得符合要求的燃油,管理局或其ROs应要求提供证据,概述为获得符合要求的燃油所做的尝试,包括对当地替代来源所做的尝试。《防污公约》附则六第18.2.4条和第18.2.5条要求船舶将无法获得符合要求的燃油的情况通知目的港的管理局/区域办事处和其他执行机构,该缔约方应将无法获得燃油的情况通知海事组织。此通知通常称为燃油不可用报告(FONAR)。
10.2.燃油不可用报告(FONAR)应以批准的格式提交,并包括船舶为获得合格燃油所做的所有尝试的证据,包括从当地替代来源获取合格燃油的尝试。

12.临时条款
12.1本通告涵盖的所有菲律宾注册船舶国际贸易应于2020年1月1日遵守。
12.2所有拟在菲律宾本地建造的用于国内贸易的新造船舶应于2025年1月1日符合要求。
12.3本通知生效后,所有船舶进口申请应在2025年1月1日前符合本通知的要求。
12.4对于在国内水域航行的菲律宾注册船舶,应分以下阶段实施:
.1所有实施LSFO的船舶应制定船舶特定实施计划(LSFO-SIP),说明公司在强制遵守日期之前将如何遵守硫限值,并应在2022年1月1日之前提交给管理部门批准。
.2所有现有船舶可在本通告生效后开始改装,并可自愿使用符合要求的燃料;以及,
.3所有船舶应在2025年1月1日前完全遵守本法规。
12.5到2025年及以后,所有菲律宾注册的船舶均应符合IMO 2020规定的硫上限。

签发菲律宾国内作业的运鱼船载重线证书指南 (MA 2023-13)
本通告是对《经修订的菲律宾注册船舶载重线检验、堪划、标记和发证规范和法规》MCSR 2021-02的补充,澄清了签发在菲律宾国内作业的运鱼船载重线证书的要求如下:
载重线证书的有效期不超过五年;
对于新建船舶,载重线证书的签发日期应为载重线初次检验和船舶安全初次检验完成日期;
如果载重线换证检验和船舶安全换证检验在证书到期日前三个月之内完成,则新载重线证书的有效期从原证书到期日算起,有效期不超过五年;
如果载重线换证检验和船舶安全检验的换证检验在证书到期后完成,新载重线证书从完成换证检验日期起有效,有效期从原证书到期日算起不超过五年;
如果载重线换证检验和船舶安全的换证检验在证书到期前三个月之前完成,新载重线证书有效期从载重线和船舶安全检验换证检验完成之日算起,有效期不超过五年。
由于菲律宾国内航行的运鱼船的特殊作业性质,载重线检验应在其法定五年坞检期间和载重线证书期满期间进行,而不是每年进行检验。
五年有效期的载重线证书到期后,不得展期。
如果载重线证书的有效期少于五年,主管机关可将载重线证书的有效期延长至第1款规定的最长期限,但应酌情增加适当的载重线检验。
本通告要求应自发布之日起生效(2023年5月10日),直到发布替代或废止本通告的对MARINA MCSR 2021-02的修订之前保持有效。

1.目标
1.1防止在菲律宾注册的符合AFS公约的船舶上使用有害防污涂料和其他含有有害物质的防污系统;
1.2促进和建立有效机制,控制和防止今后可能在船舶防污系统中使用其他有害物质,以保护海洋环境和人类健康免受其不利影响;以及,
1.3促进有效控制所有海洋污染源,并采取一切切实可行的步骤防止海洋污染。
2. 适用范围
2.1所有在菲律宾注册的造船/修船拆船实体;
2.2所有在菲律宾注册的国内和/或国际航行船舶,或悬挂菲律宾国旗的船舶;
2.3 进入菲律宾海事管辖区的所有外国注册船舶;以及,
2.4 所有进入菲律宾港口、造船厂或海上码头的船舶,但不属于第2.2和第2.3项。
本通告不适用于菲律宾拥有或经营的、目前仅用于政府非商业服务的任何军舰、海军辅助舰或其他船舶。但该类型船舶须尽力确保在合理及切实可行的范围内,符合本规例的规定。
3. 一般规定
3.1本通告涵盖的所有船舶均应采取有效措施,严格遵守《控制船舶有害防污系统国际公约》(AFS公约)附件1《防污系统控制》和“MARINA公告2015-20”中规定的要求,船舶不得在防污系统中使用或重新使用作为杀生物剂的有机锡化合物。
3.2 禁止在船舶上使用、重新使用、安装或使用有害防污系统。
3.3应限制船舶在菲律宾境内任何港口、造船厂或海上码头使用、重新使用、安装或使用有害防污系统。
3.4船舶干船坞完工后,在菲律宾注册的造船/修船实体应颁发并向管理局提交船用油漆证书,证明船舶上使用的油漆符合第4.1节的要求。
3.5所有长度为24米及以上和/或400GT及以上的船舶应获得防污底系统(AFS)证书和防污底系统记录,并应始终携带上述证书的副本。
3.6所有未获得AFS证书的船舶应始终携带AFS声明,并随附其最后一次干船坞所在船厂颁发的防污底涂料证书。
3.7本通告涵盖的所有使用不符合《AFS公约》附件1控制的防污系统的船舶,均应接受维修或更换为符合AFS公约要求的防污系统。
3.8所有进入菲律宾海事管辖区的外国注册船舶以及进入菲律宾港口、造船厂或海上码头的船舶应始终携带国际防污系统证书副本。
3.9 本通告所涵盖的船舶,在《AFS公约》生效后,装有AFS修正案附件1的防污系统,可保留该系统,直至该系统的下一次定期更新,但在任何情况下,该系统的使用期限不得超过6个月。
3.10要求所有在菲律宾注册的造船厂/修船厂/拆船厂确保以安全和环保的方式收集、处理、处置因使用或去除防污系统而产生的任何废物,以保护人类健康和环境。
4.检验和发证
4.1 MC 2018-01通函中要求的管理部门或其认可机构(RO)应在以下任何情况下进行AFS检验:
4.1.1新造船
4.1.2船舶进行干船坞检验时更换或变更防污系统时;
4.1.3 船舶重大改装、变更或改装时影响防污系统的;和/或,
4.1.4 防污系统的维修超过25%以上的。
4.2 根据第4.1节要求,在成功完成检验后,管理部门或其RO应颁发防污系统(AFS)证书。
4.3防污系统记录应显示以下细节:(作为附件1的附页)
(a) 污系统型号;
(b) 防污系统的申请日期;
(c) 所使用防污系统的公司和设施的名称;
(d) 防污系统制造商的名称;
(e) 防污系统的名称和颜色;
(f) 活性成分及其化学文摘服务注册号或CAS号;
(g) 密封剂涂层的类型(如适用);
(h) 所涂密封剂涂层的名称和颜色(如适用);和
(i) 施涂密封剂涂层的日期。
4.4当AFS系统发生变更或更换时,管理部门或其RO应重新签发/更新船舶AFS记录。
4.5国内船舶符合性监控
管理部门应定期对停靠菲律宾任何港口的菲律宾注册船舶进行随机检查,以确保其遵守本通告。
在菲律宾海域外交易的菲律宾注册船舶应在管理部门的监督下接受检验/检查。
5. 船上防污系统的采样
除非有明确理由违反本通告,否则管理局应对船舶防污系统进行简单取样。取样应符合MEPC.104(49)号决议或“船舶防污系统简要取样指南”的要求,前提是取样不影响防污系统的完整性、结构或运行。
6. 文件要求
6.1申请函;
6.2干坞证明;
6.3 购买油漆凭证;
6.4船厂的船用油漆证明;
6.5所用油漆的制造商技术数据表和材料安全数据表(MSDS);
6.6防污系统证书(用于AFS更换/重新申请);和
6.7防污系统记录(用于AFS更换/重新申请)。
7. 防污系统证书有效期
防污系统证书应保持有效,前提是AFS系统更改或更换时AFS记录应更新。
8. 收费规定/惩罚规则

9. 临时条款
9.1本通告生效后,根据本通告建造的新船舶应符合本通告的规定。
9.2本通告涵盖的现有船舶应在下一个计划干船坞期间遵守本通告要求。
9.3 本通知生效后,所有在菲律宾注册的造船厂/修船/拆船厂实体应立即遵守本规定。

1. 目标
1.1. 确保在国际贸易中航行的所有菲律宾注册船舶应遵守经修订的《2004年国际船舶压载水和沉积物控制和管理公约》(BWM公约);以及,

2. 适用范围
本通告适用于收购或经营400总吨位及以上船舶的所有个人、公司法人、合伙企业、公司和实体。
3. 豁免
本通知的规定不适用于:
3.1. 船舶不是设计或建造成用于运载压载水的;
3.2. 仅在菲律宾管辖水域内作业的船舶,除非管理局和其他主管当局在稍后日期确定从此类船舶排放压载水会损害或损害该国的环境、人类健康、财产或资源;
3.3. 在区域协定授权下作业的船舶应遵守相关区域协定的规定;
3.4. 在另一国管辖水域内作业的菲律宾注册的船舶,须经该国授权予以免除;
3.5. 仅在菲律宾水域和公海作业的船舶,但未根据第3.4点获得授权的船舶除外;
3.6. 船长小于50米且最大压载水容量为8立方米的游艇;
3.7. 总长度小于50米且最大压载水容量为8立方米的从事搜救行动的船舶;
3.8. 在密封舱中运输永久压载水的船舶,以使其不会排放;和
3.9. 任何军舰
4. 例外情况
在紧急情况下,如果在发生损害或发现损害或排放之前和之后已采取一切合理的预防措施,以防止或尽量减少排放,则行政当局允许以下例外情况;除非所有人、公司或负责人故意或不计后果地造成损害:
4.1. 为确保船舶在紧急情况下的安全或在海上救人所需的压载水和沉积物的吸收或排放;或
4.2. 船舶或其设备损坏导致压载水和沉积物意外排放或进入;或
4.3. 为避免或尽量减少船舶污染事故而使用压载水和沉积物时的吸收和排放;或
4.4. 在公海吸收并随后排放相同的压载水和沉积物;或
4.5. 船舶压载水和沉淀物在整个压载水和沉淀物产生的同一位置排放,前提是未与其他区域的压载水和沉淀物混合。如果发生混合,则根据本通告对从其他区域抽取的压载水进行压载水管理。
5. 一般规定
5.1. 本通告所涵盖的所有船舶均应采取有效措施,严格遵守《压载水管理公约》的规定。
5.2. 在菲律宾水域航行的本通告所涵盖的所有船舶均须始终携带悬挂公约缔约国国旗的船舶的国际压载水管理证书(IBWMC);
5.3. 本通告所涵盖的每艘船舶均应配备并实施压载水管理计划。此类计划应提交给管理部门或其认可组织(RO),并由其批准,同时考虑到根据《压载水公约》制定的指南。
5.4. 本通告所涵盖的每艘船舶应在船上备有压载水记录簿,该记录簿可以是电子记录系统,也可以集成到其他记录簿或系统中。
5.5. 所有进入菲律宾海事管辖区的外国注册船舶,以及进入菲律宾港口、造船厂或海上码头的船舶应始终携带国际压载水管理证书副本。
5.6. 本通告涵盖的新建造船舶应向管理局或其RO提交纳入机舱布置图的压载水处理系统(BWTS)安装计划以供验证,并应根据海事通函MC 2015-07的要求获得批准。
5.7. 本通告所涵盖的现有船舶应向管理局或其RO提交包含压载水处理系统(BWTS)的修改后的机舱布置图,以供批准,但需进行实船验证,并签发证书,说明根据海事通函MC 2015-07的要求安装BWTS。如果,船舶的稳定性受上述配件的影响,管理部门应要求重新进行倾斜试验、重新计算干舷和其他相关事项。
5.8. 本通告所涵盖的船舶使用压载水管理替代方法(仅用于研究和开发目的)时,应要求向管理局或其RO提交压载水管理系统示意图以供验证,并应根据MC 2015-07通函的要求获得批准。
5.9. 所有抵达菲律宾海域的进口船舶未配备船载压载水处理系统,只能在指定的区域进行压载水排放。
6. 特殊规定
本通告所涵盖的船舶应符合并在船上具备以下要求:
6.1. 压载水管理标准
6.1.1船舶所有的压载水排放应通过压载水管理进行,使用以下任何一种或组合:
.1 压载水交换(D1);
.2 使用BWM接收设施;以及,
.3 船载压载水处理系统(D2)
6.1.2管理当局或其RO应允许船舶仅按照《压载水管理公约》规定的以下压载水性能标准排放压载水:

1. D1标准
(压载水交换)
D-1标准要求船舶交换压载水的依据如下:
a)在公海,远离沿海地区至少200海里距离最近陆地和水域至少200米深的海里,或在行政当局和其他主管当局设立的海域;并且,
b)至少95%的水(按体积计)在远离海岸的地方交换。
注:如果船长合理地认为,由于不利天气、船舶设计或压力、设备故障或任何其他特殊情况,进行压载水交换的船舶将威胁船舶、船员或乘客的安全或稳定性,则无需遵守本条例。
2. D2标准
(压载水处理系统) D-2标准规定,船舶只能排放符合以下标准的压载水:
a)每立方米少于10个最小尺寸大于或等于50微米的活生物体;
b)每毫升少于10个活生物体,最小尺寸在10微米至50微米之间;
c)每100毫升产毒霍乱弧菌少于1个菌落形成单位(cfu);
d)每100毫升大肠杆菌少于250 cfu;及
e)每100毫升肠球菌少于100 cfu。
注:船舶上安装的压载水处理系统(BWTS)应根据《BWM公约》获得管理部门或ROs的批准,并且必须保证船舶、设备和船员的安全。
6.2 压载水管理计划
压载水管理计划应针对本通告所涵盖的每艘船舶,并应包含以下细节:
6.2.1与压载水管理相关的船舶和船员的安全程序;
6.2.2说明为实施本规则和法规中规定的压载水管理要求和补充压载水管理实践而采取的措施;
6.2.3 海上沉积物处置程序;然后,上岸;
6.2.4包括协调船舶压载水管理的程序,该程序涉及在获得当局事先书面许可的情况下排放入海;
6.2.5指定船上负责确保计划正确实施的船员;
6.2.6包含本通告规定的船舶报告要求;以及,
6.2.7 用英语书写
6.3压载水记录簿
6.3.1本通告所涵盖的每艘船舶均须备有压载水记录簿,该压载水记录簿可为电子记录系统,或可并入另一记录簿或系统,且至少须载有以下资料:
.1 船名
.2 IMO号
.3 总吨位
.4 压载水总容量(立方米)
.5 船舶有压载水管理计划;以及,
.6 显示压载舱的船舶示意图
6.3.2压载水记录簿条目应在船舶上保存至少两年,自最后一次录入后,此后由公司保存至少三年。
6.3.3 如果根据第3节和第4节排放压载水,或将压载水排放至接收设施,或发生本通告未另行豁免的其他意外或异常排放压载水,则应在压载水记录簿中记录上述情况,以及排放的原因。
6.3.4压载水记录簿应随时可供管理部门或其RO在任何合理时间检查。
6.3.5与压载水有关的每项操作均应立即在压载水记录簿中完整记录。每份记录应由负责相关作业的船员签字,每一页填写完毕后应由船长签字。
6.3.6压载水记录簿中的项目应使用英语书写。
7. 检验与发证
7.1. 管理部门或其认可机构(RO)应在以下任何情况下进行压载水管理检验:
.1新造船
.2现有船安装压载水管理系统
3 压载水管理系统的实施;和/或,
.4本通告的豁免申请
7.2. 管理部门或其负责人应在根据本通知要求完成评估后批准BWM计划。
7.3. 在按照本通告成功完成检验后,管理当局或其RO应颁发国际压载水管理(BWM)证书。
7.4. 管理部门或其RO和其他主管当局可根据《BWM公约》下的指南,对压载水记录簿进行检查和/或对船舶压载水进行取样。
7.5. 管理部门或其RO应严格重新签发/更新船舶压载水管理记录。
7.6. 管理局应定期抽查停靠菲律宾任何港口的菲律宾海外注册船舶,以确船舶保遵守本通告。
7.7. 在海外交易的菲律宾注册船舶应根据通告MC MS-2020-02要求进行检验/检查,以履行管理部门的监督职能。
8. 临时条款
8.1. 2017年9月8日之日或之后建造的本通告所涵盖的新船舶,自投入使用之日起,应满足D-2法规排放标准。
8.2. 在2017年9月8日之前建造的本通告所涵盖的船舶,应通过根据《国际防止船舶造成污染公约》(MARPOL)附则l对应的国际油污染防止证书(IOPP)相关的船舶进行的第一次或第二次五年换证检验,遵守D-2条标准。
8.3. 本通告所涵盖的船舶在第一次换证检验日期前,即第一次换证检验发生时,应符合D-2标准的规定:
.1 2019年9月8日或之后;或
.2换证检验已于2014年9月8日当天或之后,但在2017年9月8日之前完成。
8.4. 本通告所涵盖的船舶应在其第二次换证检验日期,即第一次换证检验发生时,符合D-2条标准:
.1 2017年9月8日之后;以及,
.2 2019年9月8日之前
8.5. 自2017年9月8日起,所有现有船舶应至少满足D-1(压载水交换)标准。
注:船舶也可选择安装压载水管理系统或以其他方式满足D-2(排放)标准,但在相应的合规日期之前,这不是强制性的。
8.6. 如果管理部门和其他主管当局确定,所有或部分菲律宾注册国内船舶的压载水排放将损害该国的环境、人类健康、财产或资源,则可能需要菲律宾注册的国内船舶遵守本通知。

1. 经修订的 1966 年国际载重线公约
(ICLL)适用于所有在菲律宾注册的长度 15 米及以上的船舶,无论其从事国际或国内航行。
2. 本通函所涵盖的船舶,国内航行船舶未经主管机关或国际航行船舶未经认可组织按照本规则和规定进行检验、标记并签发载重线证书后,不能开航。 .
3. “RP”或“Republic
of the Philippines”应在通过环中心的水平线上方或在其上方和下方的载重线环旁边标明。该标记应由不超过四个首字母组成,以识别管理局的名称,每个首字母高约 115 毫米,宽约 75 毫米。

6. 在测量小于 24 米但大于 15 米的船舶,24 米长度船舶在公约表格中的200
毫米干舷值也应向下延伸适用于 15 米长度的船舶,包括ILLC 66所示的相应修正计算。
7. 载重线证书的五(5)年有效期后,不能展期。但是,主管机关可以将证书的有效期延长至其航行至完成对船舶进行检验的港口。
8. 船舶无载重线证书或载重线证书失效的,不得签发/换发其他安全证书。
9. 如果载重线证书被主管机关失效或被取消,发给船舶的其他安全证书被视为自动暂停,船舶处于“不适航状态”。
10. 主管机关或其认可RO组织完成所需的检验、计算、堪划、标记等,并提交所有要求资料后,主管机关应为国内航行船舶签发全期载重线证书。或其认可的RO组织为国际航行船舶签发全期证书。但是,应向主管机关提交一份国际载重线证书和载重线检验报告的副本。

该通涵适用所有在菲律宾注册或将在菲律宾国旗下注册,从事国内和国际业务的船舶,但以下情况除外:

2. 本通函所涵盖的所有在菲律宾注册的船舶,无论是从事国内业务还是国际业务,船上必须始终持有由菲律宾主管机关签发的国内船舶吨位证书,RO签发的国际航行船舶吨位证书3. 除长度为 15 米及以下的船舶和带有支架的摩托艇外,所有在菲律宾注册的船舶均应按照经修订的 1969 年国际船舶吨位公约的适用规定进行测量。对于在菲律宾注册的国际船舶,可由认可组织对其进行计量和认证,但国际吨位计量证书采用的吨位计算应由主管机关签发。
4. 当船舶未持有吨位证书或吨位证书失效时,其他船舶安全证书不得签发或换新。
5. 当吨位证书失效,其他船舶安全证书自动暂停;船舶处于“停航状态”。

国际航行的菲律宾旗接受并适用船舶噪声等级规则(MARINA ADVISORY NO. 2023-17)
本通告介绍了SOLAS Il-1章,3-12条引入的关于“噪音的防护”的新要求,对菲律宾旗船舶,适用性和技术要求与《船舶噪声等级规则》的要求是一致的,但菲律宾海事主管机关要求有关噪音水平的问题应纳入到安全管理体系,应让海员了解暴露于高噪音和长时间暴露在噪声环境中的危害。
国内航行客滚船的预防措施和其他与安全相关的操作 MARINA ADVISORY

所有船长和船东/经营人须严格遵守下列预防措施和其他与安全有关的事项:
a.定期检查所有水密甲板和舱壁;
b.确保水密门、舱口和坡道(ramp)在离港前关闭,并在整个航程中定期检查;
c.确保定期检查和妥善维护舱室、人孔、空气管道和其他船体外部结构装有的垫圈、铰链盖密封、紧固机构;
d.货物应按照船舶批准的《货物系固手册》(CSM)存放、捆扎固定;
e.通道必须保持安全,没有任何障碍。
f.超重卡车/滚装货物,不得允许上船。
g.装载、卸载和积载的安全程序应纳入船舶的SMS手册并适当实施。
国际航行散货船的附加安全措施 MARINA
ADVISORY 2023-25
菲律宾接受SOLAS公约第12章,并对菲律宾旗国际航行散货船实施该要求。
