ADDITIONAL REQUIREMENT OF FLAG STATE
Procedure to be followed for the Application for an Exemption/Dispensation from, an Extension of and/or Acceptance of an Equivalent Arrangement to, an International Convention Requirement(Maritime Circular-MC 127 24)
1. Application
All Saint Kitts&Nevis flagged vessels.
2. Procedure
2.1 Exemption application shall be provided by the Ship's Owner/Operator, legal representative, to the Flag State Administration or CCS issuing the respective statutory certificate.
2.2 The Application for an Exemption Certificate or Letter of Dispensation(Form A16) should be filled specifying the Convention and Regulation to be exempted, the grounds for exemption, the time period requested and if there is any conditions or alternatives that the vessel have in order have the exemption approved. The application form can be downloaded from https://www.skanregistry.com/en.
2.3 In the case that the application is not submitted by CCS, CCS shall be requested to review applications, made and then submit their assessment in writing to Flag State Administration for further review and process from the Administration.
2.4 All exemptions, dispensations, equivalencies and extensions are to be issued directly by Flag State Administration.
3. Reporting
CCS are to inform the Administration immediately if a statutory certificate directly affecting the exemption is cancelled in order for the Administration to formally withdraw the exemption certificate and inform the shipowner/manager.
Procedure when the name of ship is to be changed where the ownership is remaining the same(MC/4656/1213)
Owners wishing to change the name of their ship are to make an application using Form A5(available on our website www.stkittsnevisregistry.net). This application should be made through their Maritime Registrar or to SKANReg Head Office.
Instructions to the CCSClass Societysurveyor attending to oversee the change of name as follows:
Strike through the existing name on certificates issued by SKANReg (see below **) and insert the new name in Capital Letters.
Strike through the existing name on statutory certificates issued or approved by CCS as RO for the ship and insert the new name in Capital Letters.
Sign and stamp all certificates where a change has been made with the date the name was changed.

for Dealing with Port State Control Detentions & Inspections of St.
Kitts & Nevis Registered Ships(MC 59/14 Rev.1)
Administration released Maritime Circular–MC 59
14 (Rev.1) on April 10, 2025, which give some special requirements for the ship
detention. This Maritime Circular replaces MC/34/10.For details, refer to

Main contents as following:
1 Surveys
after detention
1.1 Surveys
after 1st detention
1.1.1 When a vessel is detained, the Company Managing
of the vessel (the Managers) are obliged to inform SKANReg and to immediately
call the RO/RSO to attend. Failure to advise SKANReg
may result in a penalty charge to the owners.
1.1.2 The attending RO/RSO surveyor shall
examine the deficiencies raised and ensure that
rectification is in compliance with the
applicable Convention. However, they shall not limit the inspection solely to
the deficiencies noted by Port State Control.
1.1.3 If the date of the detention falls within
the ±3 month’s window for statutory surveys, they shall be conducted before the
vessel sails. In the case of renewal surveys, they shall be conducted to the
extent possible, except for safety equipment and radio, which shall be
completed. In the event that following rectification of the deficiencies and
lifting of the detention, port operations do not permit completion of the
surveys, a time schedule for the completion of surveys at the next convenient
port shall be set between the Managers and the RO/RSO and they shall not be
delayed until the end of the window.
1.1.4 If the date of the detention does not fall
within the ±3 months’ window the RO/RSO surveyor, after clearing the PSC
deficiencies, will carry out a general examination of the ship. Then, using
their professional judgement they will decide whether extra surveys are
required.
1.1.5 In cases where the surveyor deems it so,
the extent of the safety equipment survey shall be upgraded to that of a
renewal survey. The surveys for statutory certificates other than the safety
equipment certificate, unless they fall
within the ±3 months’ windows, shall be carried out to the extent of an annual survey.
1.1.6 Failure to inform SKANReg
and/or call in the RO/RSO may generate the following:
l An additional
audit of the company’s shore-based operations within 30 days of the date of the
detention. The audit shall address all elements of the ISM Code and all aspects
of the management system and its effectiveness in meeting the requirements of
the ISM Code.
l SKANReg may ask
the Class/RO/RSO to withdraw Statutory Certificates from arrival at the next
port so prohibiting the ship from sailing until all required surveys are
completed and an additional shipboard audit is carried out. The audit shall address
all elements of the ISM Code and all aspects of the management system’s
implementation on board.
l A penalty charge to the owners.
1.1.7 As well as the
surveys by RO/RSO surveyor, SKANReg may instruct a Flag State Inspector (FSI)
to also inspect the ship. All Expenses will be to the owner’s account.
1.2 Surveys after 2nd detention
When a vessel is detained twice within a
year (irrespective of the detaining authority/MoU), in addition to the
provisions of above paragraph 1.1. the following will be applied:
1.2.1 SKANReg may instruct the RO or RO’s that
issued the SMC and the DOC to carry out additional shipboard and shore-based
audits. The audit will address all elements of the ISM Code and all aspects of
the management system and its effectiveness in meeting the requirements of the
ISM Code.
1.2.2 Inspection of the vessel by the RO/RSO and if deemed
necessary, by a SKANReg Flag State Inspector. All the expenses will be on
owners or Managers account. The additional audit shall address all elements of
the ISM Code and all aspects of the management system’s implementation on
board.
1.3 Surveys after 3rd detention
When a vessel is detained three times within two years
(irrespective of the detaining authority/MoU), depending on the corrective
actions taken by the Managers the following may be applied:
1.3.1 Notice may be
given and necessary actions taken in accordance with the appropriate section of
the Merchant Shipping Act to terminate the vessel registration
1.3.2 The DOC of the Company
issued on behalf of St. Kitts and Nevis will be re-evaluated.。
2 Banned Ships
When a St. Kitts and Nevis vessel
is banned by a specific MoU the following will be applied:
2.1 All statutory certificates
may be suspended from the date of the banning.
2.2. An additional
audit of the company’s shore-based operations may be carried out. The audit
shall address all elements of the ISM Code and all aspects of the management
system and its effectiveness in meeting the requirements of the ISM Cod.
2.3. Statutory certificates will be reinstated provided that:
l
RO/RSO has carried out renewal surveys and there are no outstanding items
or recommendations to the extent possible.
l
RO/RSO has carried out an additional shipboard audit. The audit shall
address all elements of the ISM Code and all aspects of the management system’s
implementation on board.
l
An Inspector – Flag State Inspector (FSI) – engaged by SKANReg has
attended the vessel and confirmed, in writing, to SKANReg that the vessel
complies with Statutory Provisions& Conventions. If the FSI imposes any
recommendations, a further inspection may be required.
l
The PSC authority which has
banned the vessel has re-inspected it and the ban has been lifted.
l If the Managers do not arrange for the PSC authority re-inspection
within 3 months, notice may be given and necessary actions taken in accordance
with the appropriate section of the Merchant Shipping Act to terminate the
ships registration.
3 PSC inspection with
deficiencies identified, which did not warrant detention
3.1 Managers are
obliged to inform SKANReg of PSC inspections with deficiencies identified, even
if they do not warrant detention.
3.2 RO/RSO should also inform
SKANReg of such cases which are brought to their attention.
3.3 SKANReg will
decide whether the case warrants further investigation. On the basis of the
results of this investigation, SKANReg in consultation with RO/RSO will decide
on any future action.

3.4 In the case of a vessel having 10 or more deficiencies
identified by a PSCO, the owners are to inform SKANReg immediately for action
as deemed necessary. This may involve the actions outlined in section 1 above –
Surveys after Detention.
3.5 Failure to inform SKANReg
in the instance described in 3.4. above – may result in a penalty charge.
4.
In case a vessel has had
recommendations/class conditions imposed either by SKANReg or PSC, these shall be communicated by the Managers
to RO/RSO and the latter
shall ensure that they are rectified according to the set
schedule. Otherwise, RO/RSO shall contact SKANReg for a decision on the action
to be taken.
5 Where
a vessel is detained following a PSC inspection the report of which gives one
or more ISM related deficiencies as grounds for the detention
5.1 An additional audit of the vessel may be requested by SKANReg. The audit shall
address all elements
of the ISM Code and all aspects
of the management system’s implementation on board.
5.2 If, during the additional shipboard audit,
one or more major non-conformities are raised, an
additional audit
of the company’s shore-based operations may be carried out. The audit shall
address all elements of the ISM Code and all aspects of the management system
and its effectiveness in meeting the requirements of the ISM Code.
5.3 If the RO/RSO classes the vessel and also
issues the ISM certification, then in cases where the RO/RSO deems an
additional shipboard audit necessary, RO/RSO shall immediately notify SKANReg
and proceed as soon as possible to conduct the additional shipboard audit and
inform SKANReg of the results.
5.4 If RO/RSO classes the vessel but does not
issue the ISM certification, the RO/RSO shall notify the vessel’s auditing
organization and SKANReg of the findings.
5.5 SKANReg shall be notified by the RO/RSO of any additional
shipboard or shore-based audit.
5.6 SKANReg shall decide the extent and scope
of additional shipboard audits and shore-based audits of a Company, if a large
proportion of a Company’s fleet is detained by PSC.

REQUIREMENT FOR SHIPS TO BE ‘CLASSED’(MC/48/13)
With effect from 1st October 2013, all cargo ships of 500GT and above and all passenger vessels of whatever gross tonnage that apply for registration as a St. Kitts & Nevis flag ship will have to be ‘Classed’ by a Class Society with which St. Kitts & Nevis has an agreement for the delegation of statutory services and to act as a Recognised Organisation of St. Kitts & Nevis. The ships shall maintain onboard a Class Certificate(s) that certifies that its structure, machinery and electrical equipment are in full compliance with the appropriate International Conventions for the size, type and trade of the ship. See SOLAS Ch.II-1 Reg.3.1.
Existing ships that are currently ‘without Class’ will be required to enter into Class with one of theaforementioned Society’s by 31st December 2014.
Cargo ships of less than 500GT, non-propelled vessels, wooden vessels, fishing vessels and pleasure yachts are exempt from this requirement, though it is recommended that the owners consider ‘classing’ them.

Consultation from CCS about the MC-118 22.pdf
1. Vessels registered with the St. Kitts & Nevis Flag are permitted more than one (1) load line freeboard assignment. However, only one (1) load line freeboard mark may be displayed at any time.
2. The maximum number of load lines that may be assigned to a vessel is 5 (five).
3. To obtain approval for more than one (1) load line, an owner/manager must make a request to CCS. CCS will advise the St. Kitts & Nevis Flag and provide the information of the request.
4. The information will be reviewed and CCS will be authorized to proceed to carry out the necessary geometric, strength and stability calculations and perform the required surveys.
5. CCS shall then issue Certificates for each load line freeboard assignment and forward to the St. Kitts & Nevis Flag a copy of each provisional and full term ILLC.
6. The Master must ensure that only the freeboard marks for the intended voyage are exhibited on the vessel’s hull and all others are to be painted over before the loading of cargo begins.
7. Only the Load Line Certificate in use should be displayed. All Load Line Certificates not in use shall be replaced in a sealed envelope and locked in the Master’s safe.
8. The Master may alter a freeboard mark(s) for the vessel in accordance with the applicable Load Line Certificate and Assignment Book. The Master shall enter the change in the vessel’s official logbook. There is no need to have a CCS surveyor present at the alteration of the freeboard marks.
9. During periodical inspection required by Article 14(c) of 1966 International Convention on Load Lines, the attending CCS surveyor shall verify the Load Line marks and endorse the corresponding Load Line Certificate.
10. A Load Line Assignment Book shall be issued by CCS (4 copies), that will contain relevant data pertaining to the current freeboard assignments, pages for endorsement by the Master and instructions to be followed when changing from one (1) load line freeboard assignment to another.
11. The copies of the Assignment Book will be distributed as follows:
a) one (1) copy to the operator for placement on board the ship;
b) one (1) copy for the owner/operators’ file;
c) one (1) copy to CCS and.;
d) one (1) copy to the St. Kitts & Nevis Flag.
12. The Assignment book will be valid for as long as the International Load Line Certificates remains valid.
13. A request by a shipowner/operator for reissuance of the Assignment Book must be made to CCS when load line freeboard assignments are added, deleted, or changed and when existing ILLCs are renewed.
14. An Assignment Book for each vessel that has been issued multiple Load Line Certificates must be on board the vessel for the use of the vessel’s Master and CCS surveyor in verifying any changes to the load line marks.

Testing ASP's
Appointed Authorized Service Providers (ASP) for testing. Full details of the testing ASP's are on our website.
Ship owners should contact these ASPs for conformance testing of their LRIT equipment. The ASP will test the equipment. There will be a fee involved for this that will have to be paid by the Owners to the ASP. The ASP will issue a Conformance Certificate to the ship with a copy to us. SKANReg do not issue the Conformance Certificate, this is issued by the Testing ASP.
When a Safety Radio survey is carried out, the RO (Class Society) will check that the equipment is operating satisfactorily and that it has been set up to transmit the position of the ship 4 times daily to our National Data Centre.
Reflagging into SKANReg
For a ship flagging into SKANReg, including those ships that are Bareboat Chartering In, at the reflagging survey, the RO will check that the equipment is operating satisfactorily and that it has been set up to transmit the position of the ship 4 times daily to our National Data Centre. Therefore, at least 7 days before the date of the reflagging Safety Radio Survey owners should send an email to Fulcrum advising them of the date of the Radio Survey so that Fulcrum can remotely turn on the LRIT equipment (PolI the equipment) and start it transmitting the ships position to our National Data Centre.
Exemption from the requirements of LRIT
Although the provisions of Regulation V/19-1 do not include any expressed provisions which allow or enable an Administration to grant exemptions from, or equivalents to, the requirement to transmit LRIT information, in exceptional circumstances this Administration may be prepared to grant an exemption for a single voyage from the requirements from SOLAS V/19-1 subject to the following recommendations contained within IMO Circular MSC.1/Circ.1295.
1) The ship is to provide a copy of the voyage or passage plan for the specific voyage to:
a. The RO (Class) responsible for issuing the SOLAS Certification
b. The Contracting Government within whose jurisdiction the port or place to which the ship is proceeding to is located and
c. To the Contracting Governments of the coast of which the ship might be navigating and
d. any changes thereto; 或 OR
2) Report its position at 6 - hourly intervals during the voyage, to the aforesaid Contracting Governments.
Ship Owners & Operators wishing to be exempted from the requirements of SOLAS V/19-1 are not required to apply to this Administration for the Exemption mentioned above, but should apply direct and provide evidence of compliance with the above to the RO(s) and/or authorized Surveyors of Ships responsible for carrying out surveys and issuing certification for the voyage in question.
BRIDGE NAVIGATIONAL WATCH SYSTEM (BNWAS)(MC/ 61/15)

2013 amendments to SOLAS Ch. V as adopted by IMO Res MSC.350(92) have resulted
in new implementation dates for vessels constructed to be fitted with BNWAS are
as follows:

2. The
2009 amendments to SOLAS Ch. V as adopted through IMO Res. MSC.282 (86) require
carriage of a Bridge Navigational Watch Alarm System
(BNWAS) complying with IMO performance standards.
3. Bridge
Navigational Watch Alarm System (BNWAS) should be installed on board, Type
approved certificates for the installed equipment should be available on board
at all times for third party inspection since installation of equipment.
4. Administrations may exempt ships which installed BNWAS prior to July 2011 from
compliance with the performance standards contained in MSC.128 (75).
5. Administrations
may exempt ships from application of this regulation when such ships will be
taken permanently out of service before their first annual, periodical or renewal
survey when the implementation date becomes mandatory for BNWAS for their type
of vessel as specified in the table 1&2.
SHIP SECURITY ALERT SYSTEM (SSAS)--MARITIME CIRCULAR – MC 15 09 (Rev.1)
The Saint Kitts and Nevis Authority has issued a circular on the installation and testing requirements of SSAS, specifying validation, testing and data retention requirements.
1.Administration prefers the application of SOLAS II-1/3-13.2.1 and 3- 13.2.4 to lifting appliances which have a safe working load below 1,000 kg.

BWMC IOPP DEHARMONISATION (MC/70/17)
This administration will authorize, upon the owners request, the de-harmonisation of the IOPP certificate and associated survey until the date in which the BWM convention comes into force.
Requests for the de-harmonisation of the IOPP certificate should follow the procedures as stipulated in Maritime Circular MC 08 09---Application for an Exemption.
Renewal inspections of the IOPP certificate that are made in advance, in order to defer the date of compliance of the BWM convention are permitted to be conducted while afloat on the provision that all applicable requirements of the renewal survey are complied with.
Authorisation is not compulsory should the operator decide to renewal all statutory certification in advance.
BALLAST
WATER MANAGEMENT CONVENTION I.O.P.P. DEHARMONISATION & COMPLIANCE WITH
REQUIREMENTS OF D1 STANDARD (MC/72/17)
This Maritime Circular supersedes Maritime
Circular MC/70/17, which should be viewed as cancelled.
This Maritime Circular is to provide guidance to
all Ship-owners, Managers & Operators of St. Kitts and Nevis vessels
regarding IMO Assembly Resolution A. 1088(28) and the requirements to comply
with D1 standard of the Ballast Water Management Convention, 2004.
This Administration has ratified the Ballast Water
Management Convention, 2004 as of 30 August 2005, in order to support a phased
implementation and ensure a smooth transition to the D-2 performance standard
of the Convention between 2017 and 2022.
In accordance with IMO Resolution A. 1088(28),
vessels are not required to comply with the regulation D-2 until its
International Oil Pollution Prevention Certificate first renewal survey
following the date of entry into force of the Ballast Water Management
Convention. The date of entry into force is 8th September 2017.
St. Kitts and Nevis International Ship Registry
notes that neither the International Convention for the Prevention of Pollution
from Ships, 1973 as modified by the Protocol of 1978 (MARPOL Convention), or
the Survey Guidelines under the Harmonised System of Survey and Certification
(HSSC) prevent vessels from carrying out their renewal inspections in advance.
After consideration
of the above, this administration will authorise, upon the owners request, the
de-harmonisation of the IOPP certificate and associated survey until the date
in which the International Convention for the Control and Management of Ships’
Ballast Water and Sediments, 2004 comes into force.
Where such authorisation is granted to
de-harmonise the IOPP certificate and associated surveys, Ship-owners, Managers
& Operators of St. Kitts and Nevis vessels must comply with the
requirements of the D-1 standard by the date in which the convention enters
into force, which is currently 8th September 2017.
Requests for the de-harmonisation of the IOPP
certificate should follow the procedures as stipulated in Maritime Circular MC
08 09 – Application for an Exemption.

International code for ships operating in polar water (Maritime Circular No.MC/68/16)
This maritime circular is to inform all recognized organizations to which this administration has delegated authority to perform and carry out statutory surveys and the insurance of statutory certificates on behalf of the government of St.Kittts&Nevis, that they are authorized to carry out statutory surveys in respect of the international code for ship operating in polar waters , which will enter into force on 01 January 2017.
All ships to which this code applies, as per SOLAS chapter XIV regulation 2.1, shall have on board a valid polar ship certificate.
Guidance on the issuance of certificates, manuals and record books under Annexes I, II and V of MARPOL for compliance with the requirements of the polar code can be taken from MEPC.1/Circ.856.
This Maritime Circular is to be read in conjunction with the following previously issued Maritime Circulars; MC/64/15 and MC/43/12 and we particularly bring your attention to the various definitions contained within MC/64/15, especially that:
· “fishing vessel” means any vessel which is used for, equipped to be used for, or of a type normally used for, fishing or related activities, and includes carrier vessels
· “carrier vessel” means a vessel which is used or intended to be used for, or of a type normally used to transport fish
As a continuation of the St. Kitts & Nevis Government’s updating of legislation and operational practices to do with the fishing industry the scope of the Vessel and Fisheries Monitoring Centre (VFMC) has been extended to cover vessel position reporting and catch and transhipment reporting for all fishing vessels, including carrier vessels.
As a result of this, all vessels are to be fitted with enhanced VFMC reporting capability. As a continuation of the St. Kitts & Nevis Government's updating of legislation and operational practices to do with the fishing industry the scope of the Vessel and Fisheries Monitoring Centre (VFMC) has been extended to cover vessel position reporting and catch and transhipment reporting for all fishing vessels, including carrier vessels(a vessel which is used or intended to be used for, or of a type normally used to transport fish).
As a result of this, all vessels are to be fitted with enhanced VFMC reporting capability. The equipment for this is available to be purchased from Fulcrum Maritime Systems who will configure the system prior to shipment to report to the VFMC.

2. Certification Procedures
2.1. Recognised Organisations who are procured for the verification services and issuance of Statement of Compliances (SOC) may issue an Interim for an initial period of 5 months.
2.2. Samples taken during the initial survey will have an adequate window to be assessed by the designated laboratory for hazardous materials therefore this Administration will require sufficient justification for any further period being granted.
2.3. Upon issuance of the Interim SOC, Part I of the IHM should be affixed to the Interim SOC and be available for inspection.
2.4. In cases of Force Majeure and Global Pandemic, Recognised Organisations are advised to take a risk-based approach with regards to Initial, Annual & Renewal Surveys. Recognised Organisations wishing to propose an alternative method to conduct the respective survey should make an application to alan.crass@skanregistry.com and liam.ryan@skanregistry.com
2.5. Issuance of any full-term Statement of Compliances will be delegated to the Recognised Organisation upon the completion of the testing phase of any samples collected.
2.6. Recognised Organisations should ensure updated IHM’s are available onboard St Kitts and Nevis vessels at the earliest opportunity.

1. Purpose
1.1. The purpose
of this Maritime Circular is to inform Maritime Registrars, Ship Owners and
Ship Operators that the European Commission has adopted four implementing
regulations for the Directive on Port Reception Facilities, three of which
apply to shipping.
2. Introduction
2.1. The Directive
on port reception facilities for the delivery of waste was adopted in 2019.
2.2. The Directive
(EU) 2019/883 of the European parliament and of the Council on port
reception facilities for the delivery of waste from prevents marine
pollution from ships by ensuring that waste generated on ships are
returned to land and adequately managed was adopted on 17th of April
2019.
2.3. The European
Commission has adopted four implementing regulations for this Directive, three
of which apply to shipping.
3. Application
Storage capacity for waste in a ship
3.1.When calling
at an EU port, ships must deliver all waste to the port facilities. An
exemption to this rule is applied for ships with sufficient capacity to
store the waste accumulated during their intended voyage until they reach
the next port of call. This Implementing Regulation (EU) 2022/89 of
21st January 2022, attached to this Maritime Circular, defines how to
determine whether a ship has sufficient storage capacity for this
exemption to apply.
Ships that produce reduced quantities of waste and manage it
sustainably
3.2. In order to reduce the amount of waste produced on board a ship this, the
Directive requires that port fees are lower for ships that produce reduced
quantities of waste, and manage it in a sustainable and environmentally
sound manner. This Implementing Regulation (EU) 2022/91 of 21st January 2022,
attached to this Maritime Circular, defines the criteria for determining when a
ship is entitled to a reduced fee for producing less waste and managing it
well.
Selecting which ships to inspect
3.3. Member States are required to inspect 15% of ships calling in their ports
to verify compliance with waste rules. When doing so, Member States must
target those ships for which the risk of noncompliance is highest. This
Implementing Regulation (EU) 2022/90 of 21st January 2022,
attached to this Maritime Circular, defines a mechanism for the selection
of ships for inspection, based on common criteria, so that the selection
is made in the same way across the EU.
4. Entry into force
4.1.These
Regulations shall enter into force on the twentieth day following that of its
publication in the Official Journal of the European Union (24th of January
2022). They shall be binding in their entirety and directly applicable in
all Member States.

ST KITTS & NEVIS INTERNATIONAL SHIP REGISTRY
MARITIME CIRCULAR – MC 144 25 COMPLIANCE WITH THE HONG KONG CONVENTION ON SHIP RECYCLING
1.In accordance with the Hong Kong Convention, after its entry into force on 26 June 2025, all vessels above 500 GT are required to develop and maintain an Inventory of Hazardous Materials (IHM), which identifies the amount and location of hazardous materials onboard a vessel.
2.For a vessel that is flying a Flag of a State that isn't a party to the Hong Kong Convention, the Convention still applies when the vessel calls at ports within the jurisdiction of party States. This means that non-party flagged vessels are expected to comply with the Hong Kong Convention requirements, such as carrying an Inventory of Hazardous Materials (IHM), being recycled at authorized facilities, and having a Ship-Specific Recycling Plan (SRP).
3.The Government of Saint Kitts and Nevis is currently in the process of ratifying the Hong Kong Convention
4.To ensure that the vessels flying the flag of the Federation of St. Kitts and Nevis comply with the applicable requirements, the Administration has authorised its Recognised Organisations to conduct the related surveys under the Hong Kong Convention on SKAN vessels above 500 GT and issue a Statement of Compliance, International Certificate on Inventory of Hazardous Materials and International Ready for Recycling Certificate on its behalf.

1.适用范围
所有圣基茨和尼维斯旗船舶。
2.程序
2.1 免除申请应由船东或船舶经营人或法定代理人提交至船旗国主管机关或CCS(当相关法定证书由CCS签发时)。
2.2 为使免除能够被批准,应填写免除证书或豁免信申请(格式A16),注明申请免除的公约和规则条款,免除的依据,申请的时限以及相关的限制条件或替代措施。申请表可以从https://www.skanregistry.com/en下载。
2.3 如果申请不是由CCS提交,CCS应审查申请,进行评估并书面提交至船旗国主管机关以供进一步审查和处理。
2.4 所有的免除、豁免、等效和展期批准应由船旗国主管机关签发。
3.报告
如果直接影响免除的法定证书被取消时,CCS应立即通知船旗国主管机关以使主管机关正式撤销免除证书并通知船东/船舶管理人。
非自航船舶SOLAS要求免除的总体性授权 (MC/28/09)
非自航船舶对SOLAS V章 15、17、18、19(不包括19.2.1.7)、20、22、24、25、26、27和28条款的免除,可由船级社在执行检验发证时办理手续,填入检验报告,不需要报请主管机关批准。

1 滞留后检验
1.1 第一次滞留后的检验
1.1.1 船舶滞留后,管理公司应立即报告主管机关,并联系RO/RSO(认可组织/认可保安组织,下同)登轮,如未报告主管机关,可能会对船东处以罚款。
1.1.2 登轮的RO/RSO验船师应确保缺陷纠正,检查范围不应仅限于PSC给出的缺陷。
1.1.3 如果滞留日期在法定检验窗口期(±3个月)内,在船舶开航前应完成法定检验。对于换证检验,应尽实际可能完成相关检验项目,但需完成SE和SR检验.如果港口限制无法完成检验,管理公司应与RO/RSO制定计划,以便在下一个方便港口完成检验,完成时间不得晚于检验到期日。
1.1.4 如果滞留日期在法定检验窗口期(±3个月)之外,在消除PSC缺陷后,RO/RSO应对船舶进行总体检查,并判定是否需要进行进一步检验。
1.1.5 如果验船师认为必要,SE检验范围可以扩大至换证检验,对于其他不在检验窗口的法定证书应该按照年度检验范围进行。
1.1.6 未报告主管机关和/或未向RO/RSO申请检验,可能导致如下后果:
l
船舶滞留之日起30天内,公司接受DOC附加审核。审核包括ISM规则所有要素、管理体系各个方面及其实施ISM规则的有效性。
l 主管机关可要求RO/RSO自船舶到达下一港起取消船舶法定证书,直至完成所有要求的检验和进行一次船舶附加审核。审核应包括ISM规则所有要素和船上管理体系运行的各个方面。
l
对船东处以罚款。
1.1.7 除RO/RSO进行检验/审核外,主管机关可指派船旗国检查官对船舶进行检查。所有费用将由船东支付。
1.2 第二次滞留后的检验
如果船舶在1年内滞留2次(不论国家、备忘录),除了上述1.1的要求外,还应:
1.2.1 主管机关可指令签发SMC和DOC的RO/RSO进行SMC和DOC附加审核。审核应包括ISM规则所有要素、管理体系各个方面及其实施ISM规则的有效性。
1.2.2 由RO/RSO进行检查,若有必要,亦可由船旗国检查官进行检查。所有费用将由船东或管理公司支付。附加审核应包括ISM规则所有要素和船上管理体系运行的各个方面。
1.3 第三次滞留后的检验
如果船舶在2年内滞留3次(不论国家、备忘录),将依据管理公司采取的纠正措施,可能会采取以下措施:
1.3.1 终止船舶注册。
1.3.2 签发的DOC将被进行重新评估。
2 被禁止入港的船舶
当船舶被某一备忘录组织禁止入港时:
2.1 所有船舶法定证书可自被禁止入港之日起暂停有效。
2.2. 可要求对公司进行DOC附加审核,审核应包括ISM规则所有要素、管理体系各个方面及其实施ISM规则的有效性。
2.3. 满足下列条件后,法定证书可以恢复有效:
l
RO/RSO已经完成了换证检验且没有遗留项目。
l
RO/RSO完成了船舶附加审核,审核应包括ISM规则所有要素和船上管理体系运行的所有方面。
l
船旗国检查官已经登轮书面确认该船满足法定要求。如船旗国检查官给出了遗留项目,可要求进行进一步检查。
l
发布禁令的PSC当局已经进行复查并解除禁令。
l
如果管理公司在3个月内未安排PSC当局进行复查,可以取消船舶注册。
3 船舶被PSC检查发现缺陷但未被滞留时
3.1 管理公司应将PSC检查时发现的缺陷报告主管机关,即使这些缺陷未导致滞留。
3.2 RO/RSO应将了解到的船舶缺陷信息向船旗国报告。
3.3 主管机关将决定是否做进一步调查,基于调查结论,决定下一步措施。
3.4 如果船舶有10个及以上的缺陷,船东应立即报告主管机关,主管机关将采取必要的如1中所述的措施。
3.5 主管机关可对未按3.4款要求进行报告的公司处以罚款。
4. 船舶无论被主管机关还是被PSC开出遗留项目或船级条件,管理公司都应报告RO/RSO并按照计划消除遗留项目。若遗留项目未能按计划消除,RO/RSO应就下一步措施请示主管机关。
5 如果船舶的滞留缺陷与ISM相关,那么:
5.1 主管机关可以要求进行一次船舶附加审核,审核应包括ISM规则所有要素和船上管理体系运行的各个方面。
5.2 如果在SMC附加审核期间,发现一个或多个严重不符合,可要求对公司进行DOC附加审核,DOC附加审核应包括ISM规则所有要素、管理体系各个方面及其实施ISM规则的有效性。
5.3 检验证书和SMC证书由同一个RO/RSO签发。如果RO/RSO认为需要进行一次附加审核,RO/RSO应立即通知主管机关,并尽快开展附加审核,附加审核结果应告知主管机关。
5.4 如果登轮检验的RO/RSO不是SMC签发机构,RO/RSO应通知SMC签发机构和主管机关。
5.5 任何SMC附加审核和DOC附加审核,RO/RSO都应通知主管机关。
5.6 如公司船队较多船被PSC滞留,主管机关将确定船舶附加审核和公司附加审核的内容和范围。
6 其他方面

船舶入级要求 (MC/48/13)
2013年10月1日起,所有500总吨及以上的货船和所有客船,申请注册为圣基茨和尼维斯船旗必须在一个船级社入 级,该船级社应经圣基茨和尼维斯授权并代表从事法定服务。入级证书应保持在船上,以证明船舶结构、轮机和电气设备完全满足根据船舶尺度、船型和贸易适用的国际公约的要求。见SOLAS II-1章3.1条。
现有未入级船舶,被要求在2014年12月31日之前加入上述船级社之一的船级。
500总吨以下的货船、非自航船舶、木制船舶、渔船和游艇免于满足该要求,但建议船东考虑入级。

1. 圣基茨和尼维斯注册船舶允许核定多于一套载重线,但任何时候只能显示一套载重线标志。
2. 船舶最多可以核定5套载重线。
3. 为获批多于一套载重线,船东/管理公司必须向CCS提出申请。CCS将通知圣基茨和尼维斯船旗国并提供申请资料。
4. 对资料进行审查后,船旗国将授权CCS进行必要的形状、强度和稳性计算,并进行所需的检验。
5. 随后,CCS将为每一核定的载重线干舷签发证书,并向圣基茨和尼维斯船旗国提交每一临时和全期国际载重线证书的副本。

9. 在进行1966年国际载重线公约第14条(c)所要求的定期检查时,CCS验船师应验证载重线标志并在相应的载重线证书上签署。
10. 载重线核定记录簿(4份)应由CCS签发,其中应包含有关当前核定干舷的数据,船长的签署页以及从一种核定干舷更改为另一核定干舷应遵循的要求。
11. 核定记录簿应按下列方式分发:
a) 经营人一(1)份副本放在船上;
b) 船东/经营人一(1)份副本用于存档;
c) CCS一(1)份副本;
d) 圣基茨和尼维斯船旗国一(1)份副本。
12. 核定记录簿与国际载重线证书的有效期保持一致。
13. 当核定干舷增加、删除或变更,以及现有国际载重线证书换新时,船东/经营人必须向CCS申请重新签发核定记录簿。
14. 每艘已签发多套载重线证书的船舶必须在船上备有核定记录簿,以供船长和CCS验船师在验证载重线标志的任何变化时使用。
散货船定义 (MC/24/09)
主管机关目前不强制要求执行MSC.277(85)散货船定义的决议,何时执行将另行通知。同时,主管机关不反对船东自愿执行上述决议。
本社在对船舶做出SOLAS公约或规范方面的其他额外要求时,特别在涉及永久检查通道(PMA)、自由降落救生艇、加强检验计划和SOLAS第XII章要求等方面,应尽到告知义务。
浸没救生服配备要求 (MC/18/09)
1. 货船上必须为每人配备一套浸没救生服。
2. 除SOLAS IX Reg. 1定义的散货船外,对于航行在下列温暖气候航区的船舶,可以免除上述要求(此项免除不需经过SKANReg批准,本社验船师在检验发证时给予考虑并填写检验报告即可):
I. 北纬300和南纬300之间的海域;
II. 纬度360以南的地中海海域(the part of the Mediterranean Ser South of latitude of 36 degrees);
III. 不包括上述I和II的、距非洲大陆沿岸20海里的海区;
IV. 整个波斯湾海域,包括直至北纬310的内陆水道。
3. 工作站(workstation)是指船员经常前往正常执行任务(不包括瞭望任务)的任何处所。远距离工作站,是指自浸没救生服存放位置起算、水平距离超过100米的工作站。
4. 值班站(watch station)是指船员正常执行瞭望任务的处所。远距离值班站,是指自浸没救生服存放位置起算、水平距离超过50米的值班站。

2、按照MSC.282(86)决议修订的SOLAS公约第V章2009修正案要求,船上安装的驾驶室航行值班报警系统(BNWAS)应符合IMO相关性能标准。
3、驾驶室航行值班报警系统(BNWAS)安装上船,其型式认可证书应保存在船上随时被第三方检查。
4、在2011年7月1日以前安装的驾驶室航行值班报警系统(BNWAS),主管机关可以受理免除执行MSC.128(75)相关要求。
5、按照表1,2中所列出的各类船舶驾驶室航行值班报警系统(BNWAS)安装实施时间,如在第一次年度检验或定期检验或换证检验之前就准备永久停止营运,主管机关对此类船舶可以免除执行相关要求。
SSAS安装与测试(MARITIME CIRCULAR – MC 15 09 (Rev.1))
圣基茨和尼维斯主管机关就SSAS的安装及测试要求发布了通函,明确验证、测试和资料保存要求。
1.对于安全工作负荷在1000kg以下的起重设备,主管机关更倾向于适用SOLAS公约第 II-1/3-13.2.1和3-13.2.4条的规定。
引航员登离船设施开展集中大检查要求(MARITIME CIRCULAR – MC 138 25)
圣基茨和尼维斯主管机关计划于2025年4月1日至6月30日开展针对引航员登离船设施的安全大检查,详见
无线电应急示位标 (MC/11/09)
所有船长为24m以上以及搭乘船员并且其航区距岸超过30海里的船舶(包括游艇和游乐船),应要求配备一台EPIRB。SKANReg还建议那些船长小于24m以上或其航区距岸未超过30海里、特别是在夜间航行的船舶配备一台EPIRB。
船东,应于船舶注册后30天内填写A18表说明EPIRB配备情况,并提交给SKANReg。
VOC管理计划批准授权 (MC/36/10)
SKANReg允许那些与之签订法定业务授权协议的船级社,按照MEPC. 185 (59) 决议和MEPC.1/Circ. 680通函批准圣旗船舶的VOC管理计划。
CAS油轮在临时注册时的检验要求 (MC/20/09)
适用于CAS要求的油轮,在换旗加入圣基茨船队之前,船级社应做如下审查:
1、现有的船旗国符合证明;
2、现有的船旗国审查记录;
3、检验资料记录。
上述审查满意之后,船级社应书面报告主管机关。SKANReg将据此授权签发三个月有效期的CAS临时符合证明。
为正常签发全期符合证明,SKANReg要求船东在临时符合证明到期前一个月提交下列资料:
1、Certified copy of the Statement of Compliance from the previous Administration;
2、Statement certifying that the RO who provided the CAS Final report to the previous Administration, is an authorized to act its behalf;
3、Status report from the RO that provided the CAS Final report to the previous Administration, confirming that at the time of transfer, all the terms and conditions justifying the issuance of the Statement of Compliance to that ship, are still valid and being maintained.
由于转级而未能获得上述报告的情况下,SKANReg还可要求代表圣政府执行换旗检验的船级社提交一个状态报告,以确认该轮仍保持在CAS最终报告阶段的事实情况。
4、A copy of the CAS Final report and the complete review record of all the CAS documentation, which the previous Administration had complied for the issuance of the Statement of Compliance and the maintenance of its validity, at the time of transfer.
STS操作计划批准授权 (MC/25/09)
SKANReg允许那些与之签订法定业务授权协议的船级社,按照MEPC59届大会决议批准圣旗船舶的STS操作计划。
为符合MARPOL附则I第37条和附则II第17条,主管机关请船东和船舶管理人每季度为船上提供最新的国家联络点清单,更新SOPEP 和 SMPEP 附件2。

未经处理的生活污水排放速率批准授权 (MC/25/09)
SKANReg允许那些与之签订法定业务授权协议的船级社,按照MEPC.157 (55)决议批准圣旗船舶未经处理生活污水排放速率表。
涉及压载水管理的IOPP换证检验(MC/70/17)
主管机关将在压载水公约生效前,根据船东的申请,授权IOPP证书的不协调和相关的检验。IOPP证书不协调的申请应根据MC/08/09通函(申请免除)中程序进行。
在IOPP换证检验的适用条件满足的情况下,允许船舶在漂浮状态下提前进行IOPP证书换证检验以推迟压载水公约符合日期。
当所有法定证书换证检验提前进行时,不需要授权。
压载水管理公约IOPP证书非协调和满足D-1排放标准(MC/72/17)
本海事通函取代MC/70/17,原海事通函作废。
本海事通函为圣基茨和尼维斯旗船舶所有人、管理人和经营人提供关于IMO 决议A.1088(28)和符合2004 压载水管理公约D-1排放标准的指导。
为了分阶段实施和确保2017年至2022年顺利过渡到符合公约D-2的排放标准,主管机关已于2005年8月30日批准了2004 压载水管理公约。
按照IMO 决议A.1088(28) 要求,船舶压载水不需要符合D-2排放标准直到压载水管理公约生效后的IOPP第一次换证检验。压载水公约生效日期为2017年9月8日。
圣基茨和尼维斯国际船舶登记机构注意到,经1978年议定书修订的1973国际防止船舶造成污染公约 (MARPOL公约),或检验协调发证系统(HSSC)的检验指南,均未禁止船舶提前进行换证检验。
考虑以上情况并基于船东申请,主管机关将授权在2004 年国际船舶压载水及沉积物控制和管理公约生效前可进行IOPP证书的非协调和相关检验。
当授权同意IOPP 证书的非协调和相关检验时,圣基茨和尼维斯旗船舶的船舶所有人、管理人以及经营人必须在2017年9月8日公约生效后符合D-1标准。
IOPP证书非协调的申请应按照海事通函MC
08 09(申请免除)中规定的程序进行。
在满足IOPP换证检验的所有适用要求的情况下,为了推迟符合压载水公约要求的IOPP证书的提前换证检验允许在船舶漂浮时进行。
当经营者决定所有法定证书换证检验提前进行时,不需要授权。
极地规则(Maritime Circular No.MC/68/16)
圣基茨和尼维斯主管机关授权所有的被认可组织代表圣基茨和尼维斯政府根据2017年1月1日起生效的极地规则进行相关法定检验并签发证书。
所有极地规则适用的船舶,应根据SOLAS公约第XIV章2.1条的要求,在船上保留一份极地船证书。
为符合极地规则环境相关要求签发经修订的MARPOL公约附则I、II和V下的极地证书、手册以及记录簿指南可参考MEPC.1/Circ.856。
本海事通告须与下列先前发出的海事通告一并阅读,MC/64/15、MC/43/12并需要特别注意MC/64/15中的下列定义:
“渔船”系指用于、装备用于或通常用于捕鱼或有关活动的船舶,包括运输鱼类船舶。
“运输鱼类船舶”是指用于或装备用于运输鱼类的船舶。
圣基茨和尼维斯船舶及渔业监察中心(VFMC)的管理范围已扩展至所有渔船,包括运载船只的船位报告及渔获量及转运报告。所有船舶需要配备加强向VFMC报告的能力。设备可从Fulcrum海事系统公司购买,该公司将在发货前安装该系统并向VFMC报告。订单正常将在两周内处理,但取决于供货情况和发货时间。Fulcrum海事系统将在收到VFMC设备的全部清付款项(包括适用的运费、税金和关税)后,才安排将设备发到船东指定的地址。

小船/非自航船/非公约船检验发证 (MC/10/09)
下列商船的检验发证要求详见MC/10/09:
1) 船长小于24m;
2) 总吨小于500GT船舶;
3) 非自航船舶;
4) 其他非公约船舶。
渔船(海事通函No.MC/66/16, 2016年10月)
按照圣基茨和尼维斯政府关于渔业立法和操作的最新要求,所有渔船,包括运鱼船(用于或欲用于以及通常用于运鱼的船舶),应向船舶与渔业监督中心(VFMC)报告船位以及捕鱼和转船为此,所有渔船和运鱼船应配备VFMC强化报告设备。该设备可以从Fulcrum Maritime Systems购买,该公司会在发货前给设备配置向VFMC报告的系统。
船东在订购时务必申明是要购买可向圣基茨和尼维斯船舶与渔业监督中心(VFMC)报告的设备。自2016年12月31日起,适用船舶应配备该设备,否则可能导致失去船舶注册资格。

欧盟《港口接收设施指令》(MC 111 22)

1、目的
本通告的目的是通知海事登记官、船东和船舶经营人,欧盟委员会已通过了四项关于港口接收设施指令的实施条例,其中三个适用于航运。
2、引言
欧洲议会和理事会于2019年4月17日通过了关于港口接收设施的指令(EU) 2019/883,以确保船舶产生的废弃物返回陆地并得到充分管理,从而防止船舶造成海洋污染。
欧洲委员会为该指令通过了四项实施条例,其中三项适用于航运。
3、应用
船上废物的储存能力
3.1当船只在欧盟港口停靠时,必须将所有废物运送到港口设施。本规则的豁免适用于有足够能力储存在预定航行期间直至到达下一个停靠港期间积累的废物的船舶。附于本海事通告的实施条例(EU)2022/89,定义了如何确定船舶是否具有适用本豁免的足够存储容量。
减少废物产生并进行可持续管理的船舶
3.2为了减少船舶产生的废物量,该指令要求对产生废物量减少并以可持续和环保的方式管理废物的船舶降低港口费用。附在本海事通告的实施条例(EU) 2022/91,定义了确定船舶何时有权因减少废物产生和妥善管理而减免费用的标准。
选择要检查的船舶
3.3欧盟成员国被要求检查停靠其港口15%的船舶,以核实其是否遵守废物处理规则。在这样做时,会员国必须以不遵守规定风险最高的船只为目标。附于本海事通告的实施条例(EU) 2022/90定义了一种基于共同标准的选择检查船舶的机制,以便在整个欧盟范围内以相同的方式进行选择。
4、生效
本条例应于其在欧盟官方期刊上发表后的第20天(2022年1月24日)生效。它们应全部具有约束力,并直接适用于所有会员国。

利雅德备忘录开展起货设备集中大检查(MARITIME CIRCULAR – MC 133 24)
圣基茨和尼维斯主管机关发布了利雅德备忘录关于起货设备CIC大检查提醒,提醒注意验证有关要求的符合性。
圣基茨和尼维斯船旗国发布海事通告,《香港公约》于2025年6月26日生效。
1.根据《香港公约》,在2025年6月26日生效后,所有500总吨以上的船舶都必须编制和保存一份《有害物质清单》,以确定船上危险物质的数量和位置。
2.对于悬挂非《香港公约》缔约国旗帜的船舶,当其停靠缔约国管辖范围内的港口时,该公约仍然适用。这意味着非缔约国船旗的船舶仍需遵守《香港公约》的要求,例如携带有害物质清单(IHM)、在获授权的设施进行拆解以及制定船舶特定拆解计划(SRP)。
3.圣基茨和尼维斯政府目前正在批准《香港公约》。
4.为确保悬挂圣基茨和尼维斯联邦国旗的船只符合相关要求,管理部门已授权其认可机构对超过 500 吨载重的船只进行相关检查,并代表其出具《符合证明》、《危险货物清单国际证书》以及《国际可回收利用准备证书》。
